Dear Tyler,

Freedom of Information request no. 8-2025

I refer to your request to OPC under the Freedom of Information Act 1982
(FOI Act) for access to documents.

The purpose of this email is to advise you that your request has been
transferred to another agency.

Under section 16(1) of the FOI Act, OPC, with the agreement of the other
agency, may transfer the request to the other agency if the requested
document is not in the possession of OPC but is in the possession of the
other agency or if the subject matter of the document is more closely
connected with the functions of the other agency.

OPC conducted initial searches and did not locate relevant documents for
your request. OPC, with agreement, transferred your request to The
Department of Infrastructure, Transport, Regional Development,
Communications and the Arts who are in possession of the documents.

We received your request on 19 August 2024 and the 30 day statutory
period for processing your request commenced from the day after that date.
The transfer of your request does not affect the due date for completion
of your request. You should therefore expect a decision from The
Department of Infrastructure, Transport, Regional Development,
Communications and the Arts by 18 September 2024.

However, the statutory period of 30 days may be extended if The Department
of Infrastructure, Transport, Regional Development, Communications and the
Arts needs to consult third parties or for other reasons. The Department
of Infrastructure, Transport, Regional Development, Communications and the
Arts will advise you if this happens.

If you have any questions about this transfer, please contact us by email
to [1][email address].

If you have any other questions about your request, the contact details
for The Department of Infrastructure, Transport, Regional Development,
Communications and the Arts are [2][email address].

Dear Tyler

I acknowledge your request for access to documents under the Freedom of
Information Act 1982 (FOI Act) made to the Office of Parliamentary Counsel
(the OPC). On 23 August 2024, the OPC transferred your request to the
Department of Infrastructure, Transport, Regional Development,
Communications and the Arts (the Department) under section 16(1) of the
FOI Act.

You have requested access to:

A copy of the Australian Capital Territory National Land (Leased)
Ordinance 2022, as made with signature of the Governor-General and
relevant ministers.

The document you are seeking access to is in the possession of the
Department of Prime Minister and Cabinet (PM&C).

Under section 16(1) of the FOI Act, we are able to transfer a request if
the requested document is not in the possession of this Department but is
in the possession of another agency. As such, on 3 September 2024 your
request was transferred to PM&C.

Your request was originally lodged with the OPC on 19 August 2024 and the
30 day statutory period for processing your request commenced from the day
after that date. PM&C will treat your request as though it was received it
the same day that the OPC did. You should therefore expect a decision from
PM&C by 18 September 2024.

The FOI team at PM&C will be in contact with you shortly. They can be
contacted on [1][email address].

Kind regards
