Dear Department of Health,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Department of Health's handling of my FOI request 'Any or All documents presenting and referring to the isolation of of the Sars Covid 2 / Covid 19 virus as a independent biological viral entity from at molecular level'.
I have been provided links to various studies.
I particulary wanted documentation utilised by the Department of Health in developing their position in relation to Covid 19.
The Department did not specify if these documents were utilised in developing their position.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/a...

Good afternoon Mr Peos
Thank you for your two emails sent on 14 January 2022 in regards to two FOI requests with the Department of Health.
We note that you have requested an Internal Review of a decision issued on 1 December 2021 in relation to FOI-3149 (reference: [FOI #7913 email]).
We also note that you have requested a review of a second request sent to the Department of Health (addressed to the Therapeutic Goods Administration (TGA)), reference: [email address]. That request has a Department reference of FOI-3172. You have indicated in your request for a review that a decision in this request is overdue.
The TGA is part of the Department of Health. The decision issued to you on 1 December 2021 related to both FOI-3149 and FOI-3172. As such, the Department has two requests on hand, which are the similar or same in scope, and for which one decision on access was issued, on 1 December 2021.
The FOI Act provides a right for an applicant to seek an internal review of a decision within 30 days of the date of the decision. As such, your request for an internal review is currently outside the timeframe permitted by the Act. The Department, is however, agreeable to an extension to that timeframe, and to accept the request for internal review outside that timeframe. Could you please confirm that you would like the Department to extend the timeframe and proceed with your request for an internal review?
Alternatively, you have 60 days from the date of the decision being notified to you to request an external review by the Australian Information Commissioner.
Details of your rights in relation to the reviews are set out in the decision provided to you on 1 December 2021.
With kind regards
Alison
