To the FOI Team; Legal Services Branch; Integrity Group; National Indigenous Australians Agency,

Dear FOI Team,

Thank you for your response to my FOI request dated 1 July 2024. While I understand that the data and statistics I requested are more closely related to the functions of the Department of Health and Aged Care, I wish to remind the National Indigenous Australians Agency (NIAA) of its established role and responsibilities.

The NIAA was instrumental in establishing the National Aboriginal Community Controlled Health Organisation (NACCHO), which oversees 145 Aboriginal Community-Controlled Health Organisations (ACCHOs). These organisations played a significant role in the implementation and execution of policies and programs related to SARS CoV-2, including those under "Operation Covid Shield" and "Operation Covid Assist". These operations were part of a "Whole-of-Government" approach that included participation from the Australian Department of Defence.

Given the NIAA's foundational role in establishing NACCHO and orchestrating its ACCHOs' involvement in these operations, the NIAA bears responsibility for the resulting injuries, harm, hospitalisations, ICU admissions, and deaths among Aboriginal and Torres Strait Islander peoples caused by or in connection with SARS CoV-2.

I humbly request that the NIAA acknowledge its responsibilities and provide the requested data and statistics, or at the very least, liaise directly with the Department of Health and Aged Care to expedite the provision of this necessary and vital information.

In good faith and good will, without malice, deception or prejudice.

Yours sincerely,

:Deborah-May: Torrens

Good afternoon,

I refer to your request received by the Department of Health and Aged Care
(the department) on 1 July 2024 for access to documents under the Freedom
of Information Act 1982 (FOI Act). You have requested access to:

Can you provide me with current data and statistics showing the number of
Aboriginal and Torres Strait Islander's who have been injured,
hospitalised, placed on ventilators and died in connection with or as a
result of SARS CoV-2 infection?

The department has reviewed the scope of your request and believes that in
its current form there is uncertainty in the interpretation, which could
result in the request being incorrectly processed.

Taking this into consideration, we are contacting you to help you clarify
the scope of your request.

Scope clarification

We wish to clarify the time period referred to in your request as ‘current
data’. This part of your request is very broad in nature and we ask that
you specify a date range for the requested data.

For example, you could narrow the timeframe of the data to between 1
January 2024 to 1 July 2024, alternatively you could supply a timeframe.

We would be grateful if you could review the above and provide a response
by close of business 17 July 2024.

Kind regards,

Good afternoon,

Thank you for your prompt response regarding my Freedom of Information request dated 1 July 2024, in which I sought access to specific data concerning the impact of SARS CoV-2 on Aboriginal and Torres Strait Islander populations.

To clarify the scope of my request as per your guidance, I am interested in obtaining data covering the period from 20 March 2020 to 15 July 2024. This timeframe should hopefully provide a comprehensive overview of the impact throughout the course of the pandemic.

I appreciate the Department of Health and Aged Care's assistance in this matter and look forward to your timely processing of my request.

Thank you for your attention to this matter.

Best regards,

Deborah-May

Request for extension of time
