Underpayment of some staff by the National Australia Bank

The documents I seek are copies of correspondence from the National Australia Bank to the Fair Work Ombudsman advising of such underpayments.

The purpose of this email is to provide you with an update regarding the
processing of your request and to confirm the scope of the request.
Your Request
On 15 April 2021, you made the following request to the Fair Work
Ombudsman:
“The National Australia Bank has admitted to underpaying some of its
Australian staff.
The documents I seek are copies of correspondence from the National
Australia Bank to the Fair Work Ombudsman advising of such underpayments.”
We now seek your assistance to refine the scope of your request.
Removal of irrelevant material from the scope of your request.
Section 22 of the FOI Act allows for the removal of irrelevant information
from the scope of a request. This enables the agency to expedite the
processing of your request by removing the following types of information:
o Information that is publicly available, for example,
newspaper articles, online content including information available on
the FWO website and part of the Information Publication Scheme and the
FWO’s freedom of information disclosure log.
o Duplicate documents, including duplicate emails. The FWO will provide
emails where they form a final email chain and the authors/recipients
are contained within the final email.
o Names of FWO staff members, direct telephone numbers, email addresses
and signatures of FWO staff (other than Senior Executives);
o Personal information relating to third parties.
The removal of personal information of staff and other third parties
removes the requirement under Section 27A to extend the access decision
due date by 30 days in order to undertake consultation to obtain their
views on any proposed release.
Please note that we may be required to consult with other third parties
regarding their personal information where it appears in any documents.
Further processing of your request
We now seek your consent to the removal of irrelevant material as
described above. Irrelevant information will not be removed without your
consent.
Please confirm your agreement to the removal of irrelevant material as
described above, or advise that you object to the removal of this
information, by COB 21 April 2021.
Processing timeframes
You submitted your FOI request on 15 April 2021 and the default statutory
processing period for FOI requests is 30 days. The due date for a decision
on access to the documents you request is 15 May 2021.
If we identify that consultation with third parties is required under
sections 27 or 27A of the FOI Act, the processing period will be extended
by 30 days in accordance with Section 15(6) of the FOI Act. We will
confirm whether third party consultation is required and will write to you
if any extension to the processing period is required.
