CSV-JS-FOI (CSV), Court Services Victoria

Dear Mr. Miles,

RE: Freedom of Information Request

I refer to your request for documents under the Freedom of Information Act
1982 (Vic) (FOI Act), received in this office on 17 April 2022, made in
the following terms:

“I am seeking evidence, not limited to legal instruments, emails, notes,
communications or documents for any records of any contracts, the men
women and children of Victoria, have a service contract with a social
corporation that consented to relinquished their unalienable rights, to
consent to Jurisdiction over the men women and children of Victoria, or
claims the men women and children of Victoria are property of the
Government of Victoria any and all subsidiaries providing services to day
to day operations of the Government in Victoria Including the Office of
Governor of Victoria.”

Your request is not valid

For your request to be valid under section 17 of the FOI Act, it must be
in writing, provide enough information about the documents you asked for
so that Court Services Victoria (CSV) can properly identify them and be
accompanied by the payment of the application fee. If the terms of a
request

are not sufficiently clear, it will not comply with section 17 of the FOI
Act and CSV cannot process it.

Your request is currently not valid for the following reasons:

•            You have not paid the application fee; and

•            The terms of your request are not sufficiently clear.

Application Fee

A valid request for access under the FOI Act must be accompanied by an
application fee of $30.10 unless that fee is waived or reduced on hardship
grounds. CSV has not received a request to have the application fee waived
or reduced on these grounds. For your request to be valid, please either
provide the reasons as to why CSV should waive or reduce the application
fee or alternatively, please make payment of $30.10 which is payable by
direct deposit as follows:

The bank details are as follows:

BSB: 033-222

Account Number: 103516

Account Name: CSV Revenue Account

In the “reference” section when making a direct deposit please include
your name: i.e. Dean Miles. Until this application fee is paid, (or a
waiver is granted) your request cannot be actioned as it is not validly
made.

Terms of your request are unclear

In addition to the payment of an application fee, your request is not
sufficiently clear for CSV to identify the documents you are seeking. In
order to clarify your request, could you please provide a response to the
following question set out below:

1.           CSV is a statutory body corporate established to provide
administrative services and facilities to support Victoria’s courts and
tribunals. Please clarify whether your request relates to documents
relating to contracts with service providers that have been entered into
by CSV? If so, please provide further details as to the type of contract,
names of service providers or the nature of the services provided or being
received by CSV.

Subject to CSV receiving sufficient clarification of the above matters and
receiving payment of the application fee, your application may then be
considered valid in accordance with section 17 of the FOI Act.

Please clarify your request and submit proof of payment of the application
fee by 21 May 2022 by email at [1][Court Services Victoria request email] so that CSV can
identify the documents you seek. If we do not hear from you by this date,
we may close your request without processing it.

If you wish to discuss the contents of this email or have any further
questions, you can contact me by replying to this email.

Sincerely,
