Under section 15(5)(b) of the FOI Act the statutory time frame for processing a request is 30 days, within which a decision on access to the requested documents is to be notified. We received your request on 12 March 2023 and the 30 day statutory period for processing your request commenced from the day after that date.
Charges
AUSTRAC may impose a charge for the work involved in providing access to the documents in accordance with the Freedom of Information (Charges) Regulations. AUSTRAC’s policy is to exclude the details (name, position title, telephone and/or mobile number, and email address) of officers not in the Senior Executive Service (SES), as well as the contact details (telephone and/or mobile number and email address) of SES staff, contained in documents that fall within scope of an FOI request. If you require names, position titles and contact details of non-SES officers, or the contact details of SES staff, please inform us so that the decision maker may consider your request. Otherwise, we will take it that you agree to the information being excluded from the scope of your request.

I am writing to request an internal review of Australian Transaction Reports and Analysis Centre's handling of my FOI request 'The list of entities to whom my details have been disclosed'.
The registration process I followed for listing stated that my registration would be included on several databases, at least one of which is a public one available and searchable on the open internet. I was also selected, allegedly at random, for an audit by your department based on my presence in one of these databases, so I know for a fact that my registration details have been provided to others.
Your refusal makes mention of the term "documents": I remind you that the FoI act grants us access in respect of information in any of its forms, not just "documents".
Besides my knowledge that my records were accesses for the audit, it is also inconceivable that an expensive set of registers set up for regulation of our DCE industry could result, years later, in not one single register ever being used for any purpose.
Please obey the FoI act and provide the records I have asked for. Do not use the ambiguous term "documents" in your response - refer to the FoI act for the exhaustive list of information sources to which it applies and ensure, if you make reference at all, it include the entirety of those sources.

Thank you for your request for internal review, this matter has been assigned to FOI reference number PIAT-5033.
I'm interested in clarifying the word 'document (or documents))' being referenced within the FOI notice of decision. I can be of some assistance in defining what this term means.
In accordance with s 15(1) of the FOI Act, as well as the Office of the Australian Information Commissioner's Guidelines (specifically Part 1: Introduction to the FOI Act) the reference to documents within the FOI decision is correct on the basis FOI applications do indeed focus upon a request for documents. I also note the word documents was described within your internal review as being ambiguous. AUSTRAC uses the word document(s) in the same manner as is defined within s 4 (interpretation) of the FOI Act which may provide greater clarity in how AUSTRAC have utilised the word as well as its meaning in accordance with the FOI Act.
We’ll get to work upon your internal review right away, thank you very much.
