Processing timeframes
A 30-day statutory period for processing your request commenced from 5
August 2024, in accordance with section 15(5)(b) of the FOI Act. Therefore
the due date for a decision on access is 3 September 2024.
Extension of time request
We have undertaken preliminary searches and have been informed that our
Technical advisory branch is currently experiencing a high volume of
document requests, which may result in potential delays in fulfilling your
request within the legislative 30-day timeframe. I am therefore seeking
your agreement to a 15-day extension of time under section 15AA of the FOI
Act. If you agree to this extension, the new due date for us to make a
decision on your request will be 18 September 2024. Please let us know
whether you agree by 22/08/2024.
This period may be extended if we need to consult with third parties or
for other reasons. We will advise you if this happens.

Thank you for your response.
While it may appear to be the case, The TABIB Team are experiencing an
unusually high volume of requests due to the release of FOI 23/24 - 1189.
As a result, there has been an unavoidable delay in response times. TABIB
Team have informed us that they are unable to provide us with documents
until after 2 September 2024, therefore your request would become deemed,
and you would no longer have internal review rights. If you choose to
agree to the 15AA Extension of Time, this will ensure your application
will remain within the legislative timeframe and therefore your internal
review rights will be upheld. I make note that if the documents become
available sooner, I will endeavour to process these as a priority.

I am willing to agree to a 7 day extension if that helps? I am happy to provide further extension should it be needed on TAB workload.
While I would lose the internal review rights a deemed decision would allow an OAIC review of deemed decision.
I also would be questioning what exactly is there to do considering this a list of documents they already have, that they rely on daily/weekly and would have on hand.
This should probably be some of the easiest information to release.
Do let me know if you are happy with 7 days - or if there is a requirement for 15. I am happy to consider depending information.

I want to re-iterate that a search consultation process has been conducted
with the Technical Advisory Branch however as referenced in my previous
email, due to an unusually high volume of requests and staffing
limitations the FOI Team are experiencing larger than normal internal
delays in requesting this type of information. As the information
contained in the documents are related to complex subject matters, this
requires additional consultation with subject matter experts who can
appropriately access the material prior to our release.
We are therefore writing to you seek your agreement for an additional
15-day extension of time under section 15AA of the FOI Act. As part of
this agreement, I will provide an update to you occurring Friday week from
now until making our decision with a progress update of your request. We
kindly ask that you respond to us by 12PM 9 September 2024 with your
decision.
Once again, I sincerely apologise for the delays and any inconvenience
this may be having an impact on.
