Dear Mr Norton
Freedom of Information Request FOI18/187
I refer to your request under the Freedom of Information Act 1982 (FOI Act) for access to documents.
The purpose of this email is to advise you that your request has been transferred to another agency.
Under section 16(1) of the FOI Act, a department can transfer a request if the requested document is not in the possession of the department but is in the possession of another agency or if the subject matter of the document is more closely connected with the functions of another agency.
Accordingly, on 26 September 2018, the department transferred your request to the Department of Home Affairs.
We received your request on 21 September 2018 and the 30 day statutory period for processing your request commenced from the day after that date. The transfer of your request does not affect the due date for completion of your request. You should therefore expect a decision from the Department of Home Affairs by 22 October 2018. However, the statutory period of 30 days may be extended if the Department of Home Affairs needs to consult third parties or for other reasons. The Department of Home Affairs will advise you if this happens.
More information is available on the Office of the Australian Information Commissioner’s Website. FOI fact sheet 16: Freedom of information – Extensions of time can be accessed here: https://www.oaic.gov.au/freedom-of-infor....
If you have any questions, please contact Claire by telephone on (02) 6141 6666 or by email [AGD request email].
Yours sincerely
Claire

Dear Mr Singleton Norton,
FOI request: FA18/09/01316
I refer to your email dated 21 September 2018 in which you requested
access to documents held by Department of Home Affairs under the Freedom
of Information Act 1982 (the FOI Act).
You specifically requested access to:
'All unpublished submissions received as a result of the public
consultation of the Telecommunications and Other Legislation Amendment
(Assistance and Access) Bill 2018.'
On 22 November 2018, Department notified you of its intention to refuse
your request on the basis that the work involved in processing your
request in its current form would substantially and unreasonably divert
the resources of Department from its other operations due to its broad
nature, size and complexity.
In particular, Department notified you that, within 14 days of receipt of
that letter, you must advise Department that:
· you wish to make a revised request; or
· indicate that you do not wish to revise your request; or
· withdraw your request.
The 14 day period has now expired. As such, in accordance with section
24AB(7) of the FOI Act, Department considers that your request has been
withdrawn.
If you have any enquiries concerning this matter, please do not hesitate
to contact an FOI officer at [1][email address].
