As well as the above, I request replies from the Minister for Environment and Energy and the Compliance and Enforcement of the Department of Environment and Energy to the East Gippsland Shire Council relating to the approval of: East Gippsland Shire Council Poplar Removal Program — Grey-headed Flying—fox (Pteropus poliocephalus) Summer Camp, Bairnsdale, Victoria (EPBC 2009/5017) for the following sections:
Section 3. Regarding: As outlined in this section point by point:
a) Prior to the removal of habitat at the Mitchell River Roost Site a Hotline with a dedicated contact phone number and email address is set up to respond to public enquiries;
b) Prior to the removal of habitat at the Mitchell River Roost Site the Wellington Shire Council is notified of the proposal and provided with contact details to respond to enquiries;
c) Undertake revegetation of long-term Grey-headed Flying-fox habitat within the Bairnsdale region, in accordance with expert advice on Grey-headed Flying-fox ecology; subject to negotiation with and approval by, the Department. If a long-term Grey-headed Flying-fox camp is not established within the Bairnsdale region then revegetation or improvement of Grey-headed Flying-fox habitat within the Bairnsdale region must be undertaken; and
d) At least $5,000 is spent on community education resources relating to Grey-headed Flying-fox, including, but not limited to, educational signage at a site of Grey- headed Flying-fox habitat within twelve months of the completion of Stage Three (as detailed in the Bairnsdale Grey-headed Flying-fox Roost Site Strategic Management Action Plan).

a) Proposed methodology for dispersal;
b) Potential direct, indirect, cumulative and facilitative impacts to Grey-headed Flying- fox from the proposed dispersal activity;
c) The presence of pregnant Grey-headed Flying-fox;
d) The presence of dependant young;
e) A commitment that the dispersal will not be undertaken on a Hot Day or on or within two days of a Heat Stress Event;
f) Proposed avoidance and mitigation measures addressing potential impacts to Grey- headed Flying-fox, which must at a minimum include, stop work triggers; and
g) Monitoring and reporting protocols.
Please note: Condition 4 does not apply to an emergency dispersal.

I would like copies of the documents [does documents also mean reports and in this case submissions to the then Minister Greg Burke MP, from the Victorian Minister of what was then the Department of Sustainability and Environment [DSE] do I need to mention them by name?] and supporting documentation from Bairnsdale regional office of the then DSE, now Department of Environment, Land, Water and Planning. Which were submitted requesting approval of the (EPBC 2009/5017) permit.
I have the approval document so that is not needed again.

The Department is required to process valid requests within 30 days after
the day a request was received. This 30 day processing period may be
extended under certain circumstances, for example, where the Department
decides it reasonable to consult with third parties. If the processing
period is extended, you will be informed of the extension and the reasons
for it.
The statutory deadline for providing a decision on this request is
currently 4 October 2018.
The Department makes two assumptions that affect the scope of the request.
These are set out below.
It is the usual practice of the Department:
· not to disclose the personal information of junior officers or
the personal contact details of senior officers of the State or Federal
governments (including those of the Department). The names of senior
officers will generally be released. Your request will be processed on the
assumption that you do not intend to capture these details within its
scope.
· not to release duplicates of any document captured within the
scope of the request. Further, where two documents fall within the scope
one differs from the other only with respect to minor editorial changes
(such as spelling or grammar corrections), only the later version of the
document will be treated as within scope. Your request will be processed
on the assumption that you do not intend to capture duplicates or
documents that the Department considers duplicates (as per the above
explanation) within the scope of your request.
Please inform us if you do not agree to the request being processed by the
Department on the above assumptions.
Please note that information released under the FOI Act may later be
published online on our disclosure log.
