I would like to make a request under the FOI Act 1982 for access to portions of documents, including briefing papers, emails and any other documents, provided to the Prime Minister and the Cabinet which contain factual information about the wages and conditions in the Enterprise Agreement of SPC Ardmona.
The time period for the request is from 1 July 2013 to 22 February 2014.
I agree for the request to exclude any page or portion of a document which does not contain material which could reasonably be considered purely factual material for the purposes of clause 34(6) of Division 2 of Part IV of the Freedom of Information Act 1982.

Thank you for your email dated 22 February 2014, received by the
Department of the Prime Minister and Cabinet (the Department), in which
you made a request under the Freedom of Information Act 1982 (the FOI Act)
in the following terms:
I would like to make a request under the FOI Act 1982 for access to
portions of documents, including briefing papers, emails and any other
documents, provided to the Prime Minister and the Cabinet which contain
factual information about the wages and conditions in the Enterprise
Agreement of SPC Ardmona.
The time period for the request is from 1 July 2013 to 22 February 2014.
I agree for the request to exclude any page or portion of a document which
does not contain material which could reasonably be considered purely
factual material for the purposes of clause 34(6) of Division 2 of Part IV
of the Freedom of Information Act 1982.
Timeframe for receiving your decision
We received your request on 22 February 2014 and the 30 day statutory
period for processing your request commenced from the day after that date.
You should therefore expect a decision from us by Monday, 24 March 2014.
The period of 30 days may be extended in certain circumstances. We will
advise you if there is any extension of time.
Charges
Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the Department decides that you
are liable to pay a charge, we will send you a preliminary assessment of
the charge as soon as possible.
Publication of documents
Please note that information released under the FOI Act may later be
published online on our disclosure log at

Exclusion of officers’ names and contact details
It is the Department’s policy to withhold the names and contact details of
officers not in the Senior Executive Service (SES) within the Department
and other agencies as well as the personal mobile numbers of SES officers
contained within documents that fall within scope of the request. The
names and details of departmental and agency SES officers will not be
withheld unless there is some reason for that information to be exempt
from release. If you require the names and contact details of non-SES

consider; otherwise we will take it that you agree to that information
being excluded from the scope of your request.

I refer to previous correspondence in relation to your request. I am
writing in relation to two matters.
1. Receipt for Payment of Charges
Please see attached your receipt for the payment of the processing charge
for your FOI request with the Department of the Prime Minister and
Cabinet.
2. Third Party Consultation
As indicated in our letter of 21 March 2014 notifying of the estimate of
the processing charge, we are writing to confirm that the Department has
identified third party information relevant to your request. The
Department has formed the view that it is appropriate to consult in the
circumstances.
Under s 15(6) of the FOI Act, the statutory period for processing an FOI
request is extended by 30 days in these situations. We advise that the
timeframe for processing this request has been extended by 30 days in
accordance with that provision. Subject to any other suspensions or
extensions of time provided for under the FOI Act, the revised decision
due date is now 26 April 2014 (to be notified by 28 April 2014, as 26 and
27 April 2014 are not a business days) .
