The Financial Review published on 24 January 2025 an article with the headline 'Senior ACCC officials resign en masse from Qantas’ Chairman’s Lounge'

I would like to request the following documents under the FOI Act:

1. Any advice given to senior ACCC officials with regard to their Qantas Chairman's Lounge membership
2. Any documents detailing the decisions made by the senior ACCC officials to resign their Qantas Chairman's Lounge membership (or not resign)
3. Any documents that detail any real or perceived reputational issues, code of conduct issues, or conflict of interest issues, with regard to senior ACCC officials (or any other ACCC staff) holding Qantas Chairman's Lounge membership
4. Any instructions/advice/communications from the ACCC agency head to lower level senior officials that are related to Qantas Chairman's Lounge membership.

Unfortunately your request was not received in our FOI inbox. However, we
conducted searches of our FOI mailbox after becoming aware of your request
on Right to Know website. We found that your request had been incorrectly
filtered by the system as spam. We apologise sincerely for this and the
delay in acknowledging receipt of your request.  

 

The ACCC will be reviewing its FOI processes and procedures in this regard
and making any necessary improvements.

 

Requesting extension of time to process freedom of information request 

Under s.15AA of the Act, we urgently seek your written agreement, for an
extension of 30 days to process your request. The current due date for
decision is 2 March 2025. With the extension, the due date would be 1
April 2025.

 

Please provide your response by Friday, 28 February 2025.  

 

As advised above, your request has only just come to our attention as it
had been incorrectly filtered by the system as spam. We seek this
extension to enable us to process your request.

 

Charges

If the ACCC decides that you should pay a charge to process your request,

Dear Ms Petreski,

Thank you for your cost estimate letter.

I contend the proposed charged should not be imposed, on public interest grounds.

I believe the material is likely to be in the public interest for the following reasons:

1. There has been recent media attention on the issue of APS officials accepting gifted lounge memberships. Results include example such as :
- The Mandarin articled dated 29 Oct 2024 'Upgraded APS snared in Qantas Chairman's Lounge scandal'
- The Mandarin article dated 1 Nov 2024 'Woo hoo! I'll process this Monday : APS reacts to Chairman's Lounge invitations
- The Sydney Morning Herald article dated 4 Nov 2024 ''Losing trust': MPs say they'll quit Chairman's Lounge and Virgin VIP perks, too'

2. There is clearly a perceived or potential conflict of interest associated with public officials who accepted gifted memberships to exclusive airline lounges. This conflict of interest issue has not be explored to any depth as a public issue. The requested information will help inform debate on this issue which is in the public interest.

3. The airlines presumably have made strategic decisions with regard to choosing the individual to whom they extend membership invitations. A reasonable person would expect the airlines' would hope for a return on their 'investment', perhaps hoping they might be rewarded with favorable treatment from i) the individual gifted membership ii) the agency/department to which the individuals gifted membership belong or iii) the government

The information would come the the attention of the public as it will be published on the Right to Know website.

The information is likely to shed light onto the ACCC officials' decision to resign their memberships, as reported in the Australian Financial Review on 24 January 2025 in the article 'Senior ACCC officials resign en masse from Qantas' Chairman's Lounge. The ACCC is quoted in that article saying "The considerations in making this decision included the increasing community concerns and changing perception of this membership, particularly in light of the ACCC’s role as a consumer regulator with a remit in relation to the airline and airport sectors."

Public knowledge of this information is likely to inform public debate on whether it appropriate for other senior public officials, such as those in Senior Executive Service positions across various APS agencies, to continue the retain their memberships to Qantas' Chairman's lounge and Virgin's Beyond lounge. As an example, this includes agencies such as the ATO, Defence, Services Australia, etc.

senior ACCC officials (or any other ACCC staff) holding Qantas Chairman's
Lounge membership

4. Any instructions/advice/communications from the ACCC agency head to
lower level senior officials that are related to Qantas Chairman's Lounge
membership

*By ‘senior ACCC officials’ I mean anyone considered senior enough by
Qantas/Virgin to have been invited to their exclusive airline lounges.

*By ‘ACCC agency head’ I mean the ACCC Chair and the ACCC Chief Executive
Officer.

*By ‘lower level senior ACCC officials’ I mean staff who might have an
exclusive lounge membership, but are not the Chair or CEO

 

Under s.29(6) of the FOI Act, the ACCC has 30 days in which to make a
decision in regard to your request for a fee waiver.

Dear Ms Petreski,

Thank you for your cost estimate letter, dated 15 April 2025.

I contend the proposed charged should not be imposed, on public interest grounds.

I believe the material is likely to be in the public interest for the following reasons:

1. There has been recent media attention on the issue of APS officials accepting gifted lounge memberships. Results include example such as :
- The Mandarin articled dated 29 Oct 2024 'Upgraded APS snared in Qantas Chairman's Lounge scandal'
- The Mandarin article dated 1 Nov 2024 'Woo hoo! I'll process this Monday : APS reacts to Chairman's Lounge invitations
- The Sydney Morning Herald article dated 4 Nov 2024 ''Losing trust': MPs say they'll quit Chairman's Lounge and Virgin VIP perks, too'

2. There is clearly a perceived or potential conflict of interest associated with public officials who accepted gifted memberships to exclusive airline lounges. This conflict of interest issue has not be explored to any depth as a public issue. The requested information will help inform debate on this issue which is in the public interest.

3. The airlines presumably have made strategic decisions with regard to choosing the individual to whom they extend membership invitations. A reasonable person would expect the airlines' would hope for a return on their 'investment', perhaps hoping they might be rewarded with favorable treatment from i) the individual gifted membership ii) the agency/department to which the individuals gifted membership belong or iii) the government

The information would come the the attention of the public as it will be published on the Right to Know website.

The information is likely to shed light onto the ACCC officials' decision to resign their memberships, as reported in the Australian Financial Review on 24 January 2025 in the article 'Senior ACCC officials resign en masse from Qantas' Chairman's Lounge. The ACCC is quoted in that article saying "The considerations in making this decision included the increasing community concerns and changing perception of this membership, particularly in light of the ACCC’s role as a consumer regulator with a remit in relation to the airline and airport sectors."

Public knowledge of this information is likely to inform public debate on whether it appropriate for other senior public officials, such as those in Senior Executive Service positions across various APS agencies, to continue the retain their memberships to Qantas' Chairman's lounge and Virgin's Beyond lounge. As an example, this includes agencies such as the ATO, Defence, Services Australia, etc.
