Senate Question #90 Minister for Agriculture Barnaby Joyce
Dear Department of Parliamentary Services,
Can you please provide a copy of Senate Question #90 by Minister for Agriculture Barnaby Joyce on the 20 January 2014 by Senator Siewert.
I have looked on the parliamentary website and could not find it and called Parliament Services on the 17th March 2017 and they could not find it, nor could:
Joint Committee on Law Enforcement,
Joint Committee on the Australian Commission for Law Enforcement Integrity
Senate Select Committee into Funding for Research into Cancers with Low Survival Rates
Senate Select Committee on a National Integrity Commission
It may seem unusual to request a Public Record through FOI but all attempts to locate an electronic copy of the document have failed. The only records of the document, mention that it is late and long overdue.
Can you please also provide any correspondence which comes with the Senate Question to the Department of Parliamentary Services or any and any inquiries/correspondence/phone calls, emails etc the Department makes to the Minister or his office, Senator Siewerts Office or other Offices to locate the document.

The Senate Question has not been available on the public record up until this FOI request and information is sought documenting when the department received this information and the circumstances of its discovery.

As we advised you in our previous response dated 6 April 2017, the information you requested was not DPS information and so it was not processed under the DPS Information Request Policy. I do not consider this matter closed at all. I have requested under FOI information relating to how and when you received this Question on Notice. This is not to hard to provide. I would like to know when you received the document you supplied and any information that you have relating to it it including emails, registers showing that you receive the information etc.

The Question on Notice did not appear on your website until the FOI request was made and it is thought that this is being covered up by your department, please provide this information as per the law. As we have previously advised you, your request was not Department of Parliamentary Services (DPS) information and therefore was not processed under the DPS Information Requests Policy. You received the document from the Table Office in the Department of the Senate, which is a separate department to DPS.
DPS received the relevant document from the Table Office in the Department of the Senate at the same time you did (i.e. in the email to you on 23 March 2017).
We again advise that you direct your concerns regarding the document to the Senate Table Office via [email address].
As this is a Department of the Senate and not a DPS matter, DPS cannot assist you any further with your enquiries.

You claim in your last correspondence that the DPS who publishes the information received the information at the same time as i did in May 2017. This information was meant to be documented by the DPS at the time it was written, years earlier.
Can u please provide the correspondence that accompanied this Senate Question, including emails, letters etc? Can you please provide the request that you submitted to the Table Office in the Department of the Senate. These are your documents and you cannot legally send me to another department to access your documents.
I have seen how government coverups go and this is typical. If you have only just received this information, can you confirm that it was criminal of the Minister to not provide this information and please provide proof that this criminality has been forwarded to the DPP for prosecution.

I am writing to request an internal review of Department of Parliamentary Services's handling of my FOI request 'Senate Question #90 Minister for Agriculture Barnaby Joyce'.
The DPS has finally received the information reqested, even though they should of been given it years ago by the Deputy PM Joyce. I want to know how the DPS finally received the document and what information they sent to try and access this public record that Joyce should have submitted years ago, as per the Law.
It smells like a coverup to not provide this information. And to correct the public record, i did not receive this information in May 2017 the same time as you, as you claim
. I was sent it by Senator Siewert within 2 weeks of it being answered. She can validate she was given a copy, i have email proof.
I expect this matter to be sent to the AFP and any other investigative body to investigate corruption. It should be noted that the Deputy PM was the chief fundraiser for the Nationals who receive the bulk of there money fro chemical companies and it was the chemical companies that benefited from the Senator not providing this information on the public record to the DPP as required by Law. Future FOI requests will test whether of not the DPP has investigated and prosecuted this matter or have covered it up.
