Seeking documents concerning handling of an inquiry lodged in February for information about issue of penalty notices for breach of Archives Act that has never been answered.
Dear National Archives of Australia,
This is an application under the Freedom of Information Act.
I seek access to all documents held that relate to the handling of my inquiry NAA1000339078 lodged on 11 February 2022.
That inquiry sought access to notices issued under Section 24 of the Archives Act, and if no notices have been issued, to information about investigations of possible breaches of Section 24.
No reply was received.
In response to my follow up, Archives replied on 16 March: "We expect to respond by: 26/04/2022 04:00 PM"
No response was received.
On 12 May Archives responded to a query from me on a post on your Twitter account; "Our Reference Team have been alerted and will get back to you as soon as they can."
No one was back in touch with me.
On 16 May in response to my further follow up (on 28 April) you replied : Your inquiry has been forwarded to our Freedom of Information team. We have requested a follow-up to your inquiry from the FOI team, and someone will be in contact with you directly."
No one has been in touch with me since.
Given the circumstances I expect the decision maker in this case will exercise the discretion available and not impose charges.

The penalty for unauthorised destruction, damage or 'transfer of the custody or ownership' of Commonwealth records under s 24 Archives Act is 20 Penalty Units ($222 each unit). My attempt to find out whether any penalties have been imposed, if so on whom, or if no penalties whether any investigations have taken place met with silence since February,
I'm attempting with this application to find out what they did with my inquiry.
Since February we've had the election in May, and you have to wonder what oversight or scrutiny of records occurred as the change of government took place, interest heightened with publicity about Trump walking out the door with boxes-subject there to criminal penalties. Another dig in the making.
