SCRC's draft Marine Turtle Conservation Plan - Mapping and ALAN results
Dear Sunshine Coast Regional Council,
So that I may better understand and comment on the draft Marine Turtle Conservation Plan, please provide the:
results of the 2022 ALAN (artificial light at night) survey (as draft or final) referred to on p6 of the SC Marine Turtles Conservation Plan - Attachment 1; and
Marine Turtle Sensitive Area Mapping (as draft or final) referred to on p7 of the SC Marine Turtle Conservation Plan - Attachment 1.

I understand you were recently advised by Council’s Natural Areas team
that the relevant light survey is anticipated to be published online,
however I am advised it is still in draft.
I have also noted that you were recently given a 2020 background paper
which includes some mapping, and which was provided to the consultant in
the development of the conservation plan.
Would this provide you with information you are seeking, or could you
continue to seek the relevant documents directly from the Natural Areas
team? You may be aware that a formal access application is intended to be
a last resort.
If you do wish to make a formal access application under the Right to
Information Act 2009, then you will need to complete the application form
and provide payment of $53.90 for the application fee. The application
form and more information about the process is available from our website

If you do wish to make an application, I could give you until Tuesday, 11
July 2023 to pay the fee and complete the form. In the meantime, you are
welcome to consult with me about making your application in a way to meet

Please note that the application fee is increasing to $55.75 from
tomorrow, but as you have already submitted this request, then you would
only need to pay the current fee of $53.90, even if this is paid after
today.

Thanks for your response. My request was made following Council's Natural Areas team's response to my direct request for the mapping and draft report. For reasons not disclosed, they have declined to provide them.
I assume you've now also asked them to simply provide these items and met the same response.
So, I guess making a formal access application is the only recourse left ..... . It really shouldn't be necessary should it?.

I understand the 2022 “ALAN” light survey is proposed to be published
soon, once no longer in draft.
It is up to you whether you wish to proceed with a formal application by
paying the fee and completing the application form. As mentioned, I could
give you until Tuesday, 11 July 2023 to make your application in a way
that meets all relevant requirements, and you are welcome to consult with
me in the meantime about this.
If you do wish to continue, the easiest way to pay may be by credit card
over the phone. Please feel free to contact Council on (07) 5475 7272 if
you wish to discuss this.

I write further to my previous emails, and I have also been given your
email on 3 July which you sent directly to the Natural Areas team.
In response, I can advise that work is being undertaken to finalise and
publish the ‘ALAN’ study as quickly as possible, but we are also ensuring
that it is given the time and reviewers needed for such a large and
technical report.
In the meantime it will still be necessary for Council to fulfil its
obligations for your purported “Right to Information request”.
Do you wish to continue with a formal application by paying the fee and
completing the application form. In my email on 3 July I mentioned it is
up to you whether you wish to proceed. As requested, please let me know
about this by tomorrow (11 July), or otherwise please advise if you would
like further time to consider proceeding with an application? If you do
not respond then I may need to then send you a decision notice that your
purported application does not meet the requirements.

My previous emails had given you until 11 July 2023 to make your
application in a way that meets all relevant requirements, including by
paying the application fee and completing the application form.
Although this date has now passed, to ensure you are allowed a reasonable
opportunity to continue with your application, I am writing to ask for an
extension to the processing period. The processing period has started
when your “Right to Information request” was first submitted to Council,
but it would re-start when your application meets all necessary
requirements, as per section 33(4) of the Right to Information Act 2009).
Accordingly, as the processing period will end today, I ask for an
extension of 20 business days, which would be 9 August 2023.
This extension will now apply unless you decline it, so we do not need
your response to this extension request.
However, if you do wish to continue with your application, then we still
need you to meet all of the application requirements. I can now give you
until Wednesday, 2 August 2023 to meet the necessary requirements,
including by paying the application fee and completing the application
