I refer to your request dated 11 September 2020 seeking access to documents held by the Department of Home Affairs (the Department) under the Freedom of Information Act 1982 (the FOI Act). You have requested access to the following:
Please provide copies of all communications between the Department of Home Affairs and the International Organization for Migration or the Association of Mobilizing Community Resources (AMCOR) in Sri Lanka regarding the 2016 Safe Migration Awareness campaign conducted by AMCOR in Batticaloa, Sri Lanka.
I regret the delay in processing your request.
The Department has identified 12 documents that fall within the scope of your request. These documents contain information that an organisation or undertaking might reasonably wish to make an exemption contention because of business information within the documents.
The Department must not decide to give access to the business affairs information unless the third party about which that information relates has been given a reasonable opportunity to make submissions in support of the exemption contention.
The Department intends to consult a third party or parties prior to making a decision on access to the documents under section 27 of the FOI Act. As a result, the timeframe for processing this request has been extended by
30 days in accordance with subsection 15(6) of the FOI Act. However, I am conscious that your request is already overdue and we will endeavour to complete this process as soon as possible.
Seeking consent to disclose your identity
Consistent with the Office of the Australian Information Commissioner’s Guidelines concerning consultation processes, disclosing your identity to a third party may assist in reducing any concerns that the third party may have regarding the release of information to you. However, I am unable to disclose your identity to any third party without your consent.
Would you please indicate whether you consent to the disclosure of your identity as the FOI applicant for the purpose of the consultation process?
