Victoria Civil and Administrative Tribunal (VCAT). Although a decision may
be made to release the material, it must be withheld for 60 days pending

As this process delays your receipt of any released documentation you may
prefer to request that all personal affairs information may be redacted
from the documents as irrelevant material. Under section 33(9) of the FOI
Act, “information relating to the personal affairs of any person” includes
information that identifies any person or discloses their address or

Can you please confirm if you require access to personal information such
as names, addresses and phone numbers of individuals referred to in the
documents?

 

Under section 25 of the FOI Act, if a decision is made not to grant access
to a document on the basis that it is an exempt document and/or it
contains irrelevant material, Council is only required to provide you with
an edited copy of that document (ie, with the exempt material removed) if
you have indicated that you would wish to receive an edited copy.

On 17 March 2024 you submitted an FOI request with the following terms:

 1. I am requesting all invoices that have been paid by Hume City Council

On 24 March 2024 we received payment of the FOI application fee.

 

On 2 April 2024 at 5.26pm (effective date 3 April 2024) you clarified the
date range for point 1.

“The date range I require is from Town and Country Plumbings first job
they ever did with council and all the way to the most recent job they
done with Council.”

 

Point 1 was considered valid on 3 April 2024.

 

Point 2 is a request for information. A request made under the Freedom of
Information Act 1982 must be for information contained in documents. I
note you requested information as opposed to documents. In response to
your request for information, I confirm that various Council departments
engage Town & Country Plumbing to undertake works, including Assets and
Waste & Sustainability. I also confirm there is no executed contract
between Hume City Council and Town & Country Plumbing. I trust this
information satisfies your request for point 2.

 

The FOI Act allows 30 days processing time of a valid request plus an
additional 15 days if third party consultation is required, which it is in
this instance. Based on point 1 being valid on 3 April 2024 your request
is now due on 20 May 2024.

On 17 March 2024 you submitted an FOI request with the following terms:

1. I am requesting all invoices that have been paid by Hume City Council

to Town & Country Plumbing for all the jobs they have done for Hume.

2. I would also like to know who requested these jobs and also is this

company contracted by Hume City Council?

On 24 March 2024 we received payment of the FOI application fee.

On 2 April 2024 at 5.26pm (effective date 3 April 2024) you clarified the

date range for point 1.

“The date range I require is from Town and Country Plumbings first job

they ever did with council and all the way to the most recent job they

done with Council.”

Point 1 was considered valid on 3 April 2024.

Point 2 is a request for information. A request made under the Freedom of

Information Act 1982 must be for information contained in documents. I

note you requested information as opposed to documents. In response to

your request for information, I confirm that various Council departments

engage Town & Country Plumbing to undertake works, including Assets and

Waste & Sustainability. I also confirm there is no executed contract

between Hume City Council and Town & Country Plumbing. I trust this

information satisfies your request for point 2.

The FOI Act allows 30 days processing time of a valid request plus an

additional 15 days if third party consultation is required, which it is in

this instance. Based on point 1 being valid on 3 April 2024 your request

is now due on 20 May 2024.

April 2024 will not be disclosed.  The type of works which were conducted
