I note that you have submitted a request for access to:

 

Incident Detail Report 1-7AL08L and all attached documents including the
post-incident review.

 

As you have stated, the department notified you of a decision under s.15
of the Freedom of Information Act 1982 on 8 August 2013.  You sought
internal review under s.54(2) of the Act.  The department undertook an
internal review and notified you of the decision on 5 September 2013,
under s.54C(4).

 

I note that in the internal review decision letter the authorised decision
maker clearly advised that there were no attachments to Incident Detail
Report 1-7AL08L.  The letter also provided advice about your review rights
should you disagree with the decision made by the department, which is
that you may seek review of the internal review decision with the
Australian Information Commissioner under s.54L(2) of the Freedom of
Information Act 1982. Section 54S(1) of the Act provides that you have 60
days from the date of the internal review decision to submit a review
request to the OAIC.  As the decision on the internal review was notified
to you on 5 September 2013, you have until Monday, 4 November 2013 to
submit a review request to the OAIC.

The reasons for this advice are:

 

·         An original decision and an internal review decision under the
FOI Act have been made by the department on the document you seek.  As a
result, the department’s functions and obligations regarding access to the
document you have requested under the FOI Act are fully ‘spent’ under the
law.

 

·         You are within the timeframe to seek an external review by the
OAIC of the internal review decision made by the department.

     A previous request for this information was partially successful.

     was heavily redacted. While I understand the provisions of s. 47, I

     do not understand why the entire contents of page 2 of the document

     were redacted. Furthermore, the previous release did not indicate

     whether there were any attachments to the Incident Detail Report.

    

     Given that the documents involved in this request have been clearly

     identified and partially released I hope this request can be

     processed promptly.
