The purpose of this email is to advise you that your request has been
transferred to the National Indigenous Australians Agency (NIAA).

 

The FOI Act allows the department to transfer an FOI request to another
agency if the requested document is not in our possession, but is in the
possession of the other agency, or if the subject matter of the document
is more closely connected to the functions of the other agency. This
ensures that a decision on your request is made by the most appropriate
agency.

 

The subject‐matter of the documents you have requested is more closely
connected with the functions of the NIAA. Therefore, your request has been
transferred in full, with agreement, to the NIAA under s 16(1)(b) of the
FOI Act. The transfer of your request does not affect the timeframe for
completion. You should therefore expect a decision from the NIAA by 12
August 2024, 30 days after you submitted your question as per the FOI Act.
However, the statutory period may be extended by a period of 30 days if

Notice of Transfer

Thank you for your request to the Attorney-General’s Department (AGD) for
access to documents under the Freedom of Information Act 1982 (FOI Act).
 On 18 July 2024, your request was transferred in full to the National
Indigenous Australians Agency (NIAA) under section 16(1)(b) of the FOI
Act.

 

AGD received your request on 12 July 2024 and the 30 day statutory period
for processing your request commenced from the day after that date. You
should therefore expect a decision from the NIAA by 11 August 2024. As the
due date for your decision falls on a weekend, section 36(2) of the Acts
Interpretation Act 1901 (Cth) allows the decision to be sent the next
business day, being Monday 12 August 2024.

 

We will advise you if there are any further extensions of time, including
if third party consultation is required.

 

Charges

Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the decision-maker decides that

Information out of scope

The NIAA considers the names and contact details of Commonwealth staff not
in the Senior Executive Service (SES), such as Australian Public Service
(APS) officers, and other personal details of all Commonwealth staff (such
as signatures and direct phone numbers), as not relevant to the scope of a
request. Information that is irrelevant to your request will be excluded
from any documents which may be released to you.

 

Please note, the NIAA routinely excludes the following from documents
released in response to FOI requests:

·       duplicate documents

·       duplicate email chains

·       publicly available documents, and

·       draft or interim documents where a later version is included.

Thank you for your correspondence dated on 12 August 2024, I have contacted Jenny Brennan, the current CEO of NIAA and forwarded her all the correspondence sent to Linda Burney, Senator Dodson and Senator McCarthy, pertaining to the registration of Aboriginal Land Councils and Registered Native Title Body Corporates on American company, Duns & Bradstreet.

I was made known that for an individual to register their business on Duns & Bradstreet, they must have, or be in eof the following;

1. A business based in the United States;
2. A business based in Canada
3. An Apple Developer; or
4 Required an UFI (Unique Facility Number), to be registered with the FDA (U S., Department of Food, Drugs, and Administration).

To my knowledge, no Aboriginal Land Council or Registered Native Title Body Corporate fits none of the above-mentioned descriptions.

This why I ask that an internal investigation be conducted immediately.
