Dear Simon,
We refer to your recent GIPA application received by NESA on 20 April and
write to notify you that your access application is not a valid
application. Under [1]section 41(1) of the Government Information (Public
Access) Act 2009 (NSW), the following requirements apply for an access
application to be valid:
…(a) it must be in writing sent by post to or lodged at an office of the
agency concerned or made in the manner approved by the agency under
subsection (2),
(b) it must clearly indicate that it is an access application made
under this Act,
(c) it must be accompanied by a fee of $30,
(d) it must state the name of the applicant and a postal or email
address as the address for correspondence in connection with the
application,
(e) it must include such information as is reasonably necessary to
enable the government information applied for to be identified…^1

You would appreciate that it is not possible to acknowledge receipt of a
valid application unless the application fee or relevant payment details
accompany the application (see section [2]41(1)(c) of the GIPA Act). You
are also required to provide either a postal or email address (see section
[3]41(1)(d) of the GIPA Act). Finally, the application must either be
lodged in person at the NESA head office OR sent to NESA either by post or
from your own personal or work email address on the approved form (see
sections [4]41(1)(a) and [5]41(2) of the GIPA Act).
Should you wish to proceed with making an access application I would
invite you to submit a valid application with the required fee. For your
convenience, you can submit your application and provide payment details
by downloading and completing [6]NESA's information access form. Please
remember to complete the payment details on page 3, before sending to
[7][NESA request email].
If you disagree with NESA's decision about the validity of your
application, you do have a right of review under Part 5 of the GIPA Act.

Dear Simon,
You have the option of requesting your own personal information either via
an access application under the GIPA Act (the NSW equivalent of the FOI
Act), or under [1]section 14 of the Privacy and Personal Information
Protection Act 1998 (NSW) – “the PPIP Act”. You will note that section 14
of the PPIP Act states that:
“…A public sector agency that holds personal information must, at the
request of the individual to whom the information relates and without
excessive delay or expense, provide the individual with access to the
information.”
If you wish to request your personal information under the PPIP Act,
please email [2][email address] directly from your own email
address (i.e. not via a third party website). A small processing fee will
apply for most simple requests.
