Repair easements and retention walls.
Dear Blacktown City Council,
I'm looking at building my house in the new property being developed in Tallawong estate. lot 35, The property has a repair easement of 9000mm on the right side of the property and developer plans shows a retention wall of 600mm height out side of the repair easement.
Can the retention wall be build along the boundry/fencing within the reapair easement and then then have 900mm repair easement from the retention wall?
Would it be possible to direct me to or share related guidelines that I can refer in this regards.

Repair easements as you refer to are in normal circumstances 900mm in width along a side boundary of properties in a row along a residential street. They allow for the neighbouring property to construct a short length of the dwellings wall (usually the garage) right up to the property boundary with appropriate fire resistant construction and allow the owner legal access to the thin strip of land on the neighbouring property to maintain the wall. It is not the intent to allow any form of construction within this easement zone that would prevent access and prevent maintenance being carried out, including retaining walls.
All details relating to restrictions on properties and easements are detailed within a section 10.7 Planning Certificate that may be obtained by Council for a fee. Details on Section 10.7(2) certificates including a link to the application form may be obtained from Councils website by entering planning certificate in the looking for box.
