Communications and the Arts (the Department) under the Freedom of
Information Act 1982 (FOI Act).

Timeframes

I refer to your request for information made on 10 March 2023.
Section 15AA of the FOI Act enables the parties to an FOI request to agree
to an extension of time of up to 30 days. Due to a higher than usual
number of requests currently being managed by the Department and the need
to consult with other Commonwealth agencies in order to obtain all
information relevant to the scope of your request, the Department requires
additional time to ensure a well-informed decision on access is made.
As such, we are requesting a 10-day extension of time under section 15AA
of the FOI Act. This will result in the statutory due date for this
request being 19 April 2023.
It would assist us with the management of these requests is you are able
to advise whether you agree to this by COB 6 April 2023.
We regret the delay and advise that we are actively working to finalise
your requests as quickly as possible.

On 10 March 2023, you requested access to documents held by the Department
of Infrastructure, Transport, Regional Development, Communications and the
Arts (the Department) in accordance with the Freedom of Information Act
1982 (the FOI Act).
While processing your request, the Department has identified that your
request includes documents affecting a third party. In accordance with
Sections 27 and 27A of the FOI Act, the department is required to consult
with the third party before making a decision on the release of documents.
Section 15(6) of the FOI Act provides for an extension of 30 days to be
added to the statutory time limit for processing requests. Therefore, the
deadline for providing you with the decision on your request is now 9 May
2023.
As such, the 10 day extension of time previously requested in accordance
with section 15AA of the FOI Act, is no longer required.
Noting the above, please advise if you consent to FOI Directorate naming
you as the applicant to the third party for the purpose of consultation
by: COB 12 April 2023.
While you are under no obligation to reveal your identity as the applicant
and we will not disclose your identity without consent, in our
experience, third parties will generally be more likely to object to the
release of their information if they do not know who the applicant is.
