Registrar Mediation Accreditation

Julie-Anne made this Freedom of Information request to Federal Court of Australia

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was refused by Federal Court of Australia.

Dear Federal Court of Australia,

Practice Note CPN 1 states in paragraph 9.2 :-
“Registrars of the Court have skill and training in various types of ADR for disputes in all
PAs, including mediation, confidential conferences, case management support (such as
helping to resolve discovery disputes) and conducting expert witness conferences.”

The Court’s website contains a section entitled Mediation.
Within that section is the following statement :-
“The majority of court ordered mediations are conducted by Judicial Registrars who are trained
and accredited by the Court under the Federal Court Mediator Accreditation Scheme (FCMAS).
In recognition of the Court's unique model of mediation and commitment to a quality
professional development program, the Court became a Recognised Mediator Accreditation
Body in September 2015 and implemented the FCMAS which incorporates the National
Mediator Accreditation Standards”

I seek access to all documentation relating to the ADR accreditation of Registrar Peter Schmidt.

Yours faithfully,

Julie-Anne

Dear Federal Court of Australia,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Federal Court of Australia's handling of my FOI request 'Registrar Mediation Accreditation'.

All I am essentially seeking is documentation which evidences that Peter Schmidt has been accredited as a mediator. If this document does not exist, the public can assume Registrar Schmidt is not an accredited mediator

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/r...

The request for documentation which evidences mediation accreditation of one of the Courts senior registrars was refused. A letter dated 2 September 2021 was identified as relevant but not released. Maybe that is because the registrar in question was conducting mediations before September 2021, in other words before he was accredited.
