Does the Premier of Victoria hold any records, things including any Hansards Records page numbers etc, on the Victoria Road Safety Road Rules Act 2006 was an Act of Parliament Section. 95D of the Road Safety Act 1986....authorise the Governor-in-Council to make the rules.

Dear Dean,

 

Thank you for your request under the Freedom of Information Act 1982 (Vic)
(the Act) to the Premier of Victoria. Please note that the Department of
Premier and Cabinet processes FOI requests on behalf of the Premier.

Payment of application fee required to make an FOI request

Section 17(2A) of the Act requires that an application fee of $30.10
accompanies a request for access to documents. Payment can be via the FOI
online portal at [1]https://online.foi.vic.gov.au/foi/reques....

The application fee may be waived in circumstances of hardship. If you
wish to seek waiver of the fee, you will need to provide evidence of
hardship, such as a current healthcare or pension card.

Please note, your request will not be considered valid and will therefore
not be processed until payment or application for waiver is received and
approved.

Your request for documents

In your email of 4 May 2022, you requested access to:

“Does the Premier of Victoria hold any records, things including any

In order for a request to be valid under section 17 of the Act, it must
clearly state what documents the applicant is seeking so that the
department can identify them, and an applicant must define with as much
precision as possible the documents sought. Before we can start to process
your request, we need to ensure that it is clear enough for us to identify
relevant documents.

Clarifying the terms of your request

 

I invite you to consult with the department with a view to amending or
clarifying your request so that it is in a form which complies with
section 17 and provides the information necessary to identify the
documents sought.

Your request in its current form seeks access to ‘any’ records that may be
relevant to the Victoria Road Safety Road Rules Act 2006, without
providing a date range or further information to enable a search to be
undertaken.

 

Please provide more specific information to allow a thorough and diligent
search to commence. Below are some suggestions for your FOI request:

 

o Provide greater specificity in your request as to what categories of
documents you are seeking (for example, briefings, reports, emails,
etc). Requests must be made for specific documents or groups of
documents, not for every document in a broad category; and
o Specify a date range for your request.

  

Please note, even with clarification, it may be that the work involved in
processing your request may be so large as to divert the resources of the
department substantially and unreasonably from its other operations and
further consultation may be necessary.

 

I would appreciate it if you would respond to the issues raised above
within 28 days of the date of this email, otherwise I will assume that you
do not wish to clarify your request and no further action will be taken by
the department.

 

Next steps

To make your FOI request valid you need to pay the application fee (or
show evidence of financial hardship) and clarify the terms of your
request.
