I refer to your request to the Australian Public Service Commission (the ‘Commission’) for access to documents under the Freedom of Information Act 1982 (Cth) (‘FOI Act’) received 22 November 2022.
Under s 15AA of the FOI Act, the time for processing your application may be extended up to 30 days with your agreement.
We request your agreement to a further 30 days to deal with your request. The reason for this extension is because:
• the scope of your request is voluminous and requires extensive searches of Senior Executive Staff email inboxes within the Commission;
• the Commission is currently dealing with an increased volume of FOI requests;
• All FOI requests are processed by a small legal team that is currently short staffed and in addition must still undertake business-as-usual work in providing in-house legal services to all internal business areas; and
• Staff members within the legal team who have the skills required to process FOI requests will be on leave during and around the end of year shutdown period.
If you agree to our request for an extension of time, it would mean the new date for the Commission to provide you with a decision on your FOI request will be 21 January 2023.
Please confirm if you agree to this extension by COB Monday 12 December 2022, or at your earliest convenience.
If we do not receive a response from you, we intend to seek an extension of time from the Office of the Australian Information Commissioner under s15AB of the FOI Act.

I refer to your request to the Australian Public Service Commission (‘the Commission’) for access to documents under the Freedom of Information Act 1982 (Cth).
The Commission appreciates you have already granted an extension to process this request until 10 January 2023.
At this time, the Commission is requesting your agreement to a further 30 days to deal with your request.
I hope that by sharing our views it might give you a clearer understanding of why we are seeking this additional extension.
We have completed our document searches and are presently reviewing approximately 28 discrete documents (totalling approximately 60 pages). Following our searches, we have started to undertake a courtesy consultation process with four parties, being the Community and Public Sector Union (CPSU), the Australian Taxation Office (ATO), the Department of the Prime Minister and Cabinet (PM&C), and the Office of Senator Katy Gallagher (Minister’s Office).
At this stage, it is unlikely the Commission will meet the deadline of 10 January 2023 because:
• some of the above mentioned parties require further time to consider the documents, in particular PM&C who will be reviewing Cabinet related documents;
• the Commission is currently dealing with an increased volume of FOI requests, and all FOI requests are processed by a small legal team that is currently short staffed, and in addition, must still undertake business-as-usual work in providing in-house legal services to all internal business areas;
• the end-of-year office shutdown period occurs from 24 December 2022 until 3 January 2023; and
• staff members within the legal team who have the skills process FOI requests will be on leave during and around the end of year shutdown period.
If you agree to our request for an extension of time, it would mean the new date for the Commission to provide you with a decision on your FOI request will be 9 February 2023.
Please confirm if you agree to this extension by COB 3 January 2023, or at your earliest convenience.
If we do not receive a response from you, we intend to seek an extension of time from the Office of the Australian Information Commissioner under section 15AB of the FOI Act.

Extension of time application by Australian Public Service Commission

I write to advise that on 5 January 2023 the Office of the Australian
Information Commissioner (the OAIC) received an application from the
Australian Public Service Commission (the APSC) for an extension of time,
to process your FOI request of 22 November 2022.
APSC has applied for an extension of time under s 15AB of the Freedom of
Information Act 1982 (Cth) because your request is considered to be
voluminous and complex.
APSC has advised the OAIC that:
· The request requires consultation with four affected parties.
· Consultations have been delayed due to the complexity of the
request.
· The APSC legal team is experiencing resourcing issues during the
end-of-year shutdown period.
APSC has requested an extension to 9 February 2023. I will take any
comments you may have to make into account when deciding the application.
