Dear Michelle O’Brien
Thank you for your request for information.
We are writing to help you to narrow the scope of your request because at
this stage it appears to be too large.
Scope of your request
You have requested access to:
“…any informations [sic] on policies, procedures, memos, emails, actuarial
data that pertain to the idea of primary and seconday [sic]
disablity's/imparments [sic]. how the idea of primpary [sic] and seconday
[sic] imarment/disablity [sic] came to being a part of the planning
meeting structure and how this relates to funding of a participant who
has access to the scheeme [sic]. I also want to see any emails, policys
[sic], procedures and memos that relate to how the NDIA views the funding
of primary and seconday [sic] imparments [sic] relates the [sic] the NDIA
act.”
In order for your request to meet the requirements of the FOI Act, it must
provide enough information about the documents you are seeking to enable
us to locate them.
Based on the description you have provided, we are unable to ascertain the
specific documents you are seeking in order to continue to undertake
searches. We therefore seek your assistance in narrowing the scope of your
request.
You may for instance, wish to provide us with the following information:
1. Specific document types you are seeking access to
2. A date-range for the documents sought
3. Further information around the subject matter of your request for
information
Extension of time
In addition, we’re sorry to let you know that it’s taken us longer than
expected to process your request. This is because of the large number of
business areas that have to be consulted for the processing of your
request, due to its broad scope. Unfortunately, delays have also occurred
due to COVID-19 lockdowns which are having a significant impact on staff
and agency operations.
We are therefore writing to seek your agreement to a 30 day extension of
time under section 15AA of the FOI Act, making 20 October 2021 the new due
date to provide you a decision on access.
Next steps
Please provide us with further advice surrounding the scope of your
request and whether you agree to the above extension of time by 5pm 14
September 2021.
If you don’t agree, we may need to seek an extension from the Office of
Australian Information Commissioner.
Please contact us at [1][NDIA request email] if you have any questions or
require help.
Kind regards

Dear Michelle O’Brien
Freedom of Information request — Request consultation process
Thank you for your correspondence of 21 August 2021, in which you
requested access under the Freedom of Information Act 1982 (FOI Act) to
documents held by the National Disability Insurance Agency (NDIA).
Scope of your request
You have requested access to documents about the National Disability
Insurance Scheme (NDIS). Specifically, you requested access to:
“…any informations on policies, procedures, memos, emails, actuarial data
that pertain to the idea of primary and seconday [sic]
disablity's/imparments [sic]. how the idea of primpary [sic] and seconday
[sic] imarment/disablity [sic] came to being a part of the planning
meeting structure and how this relates to funding of a participant who
has access to the scheeme [sic]. I also want to see any emails, policys
[sic], procedures and memos that relate to how the NDIA views the funding
of primary and seconday [sic] imparments [sic] relates the [sic] the NDIA
act.”
Practical refusal
I am authorised to make decisions under the FOI Act.
I am writing to advise that your request does not provide enough
information about the documents you are seeking access to, and in its
current form is likely to result in a substantial and unreasonable
diversion of resources. This is called a ‘practical refusal reason’ under
section 24AA of the FOI Act.
On this basis, I intend to refuse your request. However, before I make a
final decision, I am writing to provide you with an opportunity to revise
your request. This is called a ‘request consultation process’ as set out
under section 24AB of the FOI Act. You have 14 days to respond to this
notice in one of the ways set out below.
Why I intend to refuse your request
On 13 September 2021, we advised you that your request did not satisfy
section 15(2)(b) of the FOI Act, as the terms of your request were too
broad. We sought further information from you about the documents you were
requesting, however you did not respond.
Request consultation process
You now have an opportunity to revise your request to enable it to
proceed.
Revising your request can mean narrowing the scope of the request to make
it more manageable or explaining in more detail the documents you wish to
access. For example, by providing more specific information about exactly
what documents you are interested in, the NDIA will be able to pinpoint
the documents more quickly and avoid using excessive resources to process
documents you are not interested in.
To reduce the scope of your request, you might like to consider:
· Providing us with the specific document types you are seeking
access to
· A date-range for the documents sought
· Further detail around the subject matter of your request for
information
You have 14 days from the date you receive this letter to contact me and
do one of the following:
a. withdraw your request;
b. make a revised request; or
c. indicate that you do not wish to revise the request.
During this period, you are welcome to seek assistance to revise your
request. If you revise your request in a way that adequately addresses the
practical refusal reason outlined above, we will recommence processing it.
Please note that the time taken to consult with you regarding the scope of
your request is not taken into account for the purposes of the timeframe
for processing your request.
You can contact me by email at [1][NDIA request email]
If you do not contact me within this period, that is by 5:00pm 1 October
2021, your FOI request will be taken to have been withdrawn under
subsection 24AB(7) and will not be dealt with any further.
Please do not hesitate to contact me if you have any questions.
Yours sincerely
