Dear Ms Brophy,

I act as legal representative for THE UNLIT FILM PTY LTD.

Under the Freedom of Information Act 1982 (FOIA), I am writing to request access to the following documentation relating to the feature film THE UNLIT (the Film), directed by Kate Whitbread and produced by my client:

(a) Minutes of any potion of a Committe Meeting at which the Provisional Certification and Final Certification of the Film was discussed.

(b) All internal and external assessor reports for Provisional Certification and Final Certification of the Film.

The information requested is neither:

1. subject to an exemption from disclosure under Part IV, Division 2 of FOIA, noting that where a document may be assessed by Screen Australia as "conditionally exempt", it is only exempt from disclosure if disclosure would, on balance, be contrary to the public interest and this is a private request made by the entity to whom the information relates. (The FOI Guidelines issued by the Office of the Australian Information Commissioner states the public interest test is considered to be "something that is of serious concern or benefit to the public" and "related to matters of common concern or relevance to a substantial section of the public");nor
2. protected information under sec 355-25(1) of the Taxation Administration Act 1953, because this request is made by the "primary" entity to whom the information relates under sec 355-25(1)(b)(ii) and I act in the capacity as a "covered" entity under 355-25(2)(b).

Please confirm receipt of this request within 14 days, and I expect your decision on or before 9 November 2020 pursuant to Part III, sec 15 of FOIA.
