Process to follow to get access to CCTV footage of Train carriage for specific Date and time.
Dear Sydney Trains,
I have recently Lost my new Phone in sydney Train. The Phone has significant emotional importance to me as it has photos of my New Born in them and i realized that they are not synced to my cloud.
Train Details:
Date: 31Jan
Train from Townhall towards richmond at around 14:04 (running late)
Got down at Wentwort ville station at Around 14:40 ( 4 min late)
when i realized i lost my phone i immediately turned however train door was closing and went off
I was in second carriage from front and sitting in upper deck. I am indian and i was in blue shirt and black pant and i had brown Parcel bag in my hand which is big size. it should give pretty good idea to look for me
I believe the phone was picked up by a person who moved to the seat after a got down.
I just want to understand if anyway i can get footage of carriage for time between 14:40 till 14:50

Requests for CCTV footage received at the Information Access Unit, Transport for NSW (TfNSW) is initially dealt with informally.
A search request was sent to the relevant area of Sydney Trains and once a response received our office will advise you of the search result.
Once the request for CCTV footage is located, you will be contacted by email and requested to apply for the information formally under the Government Information (Public Access) Act (2009) (GIPA). A fee of $30 needs to accompany the formal application.
If the incident does not involve yourself, a $30 per hour processing fee can be requested for all non-personal formal applications.
Upon receipt of your access application, agencies are required to decide an access application within 20 working days of receiving the application (subject to any suspension or extension required).

Please note access to CCTV footage, provided by TfNSW, is reviewed under the GIPA Act. Most requests for CCTV footage are released as “Viewing Only”.
If you require a copy of the CCTV footage for legal proceedings, a subpoena will be required.

In order to assist with the terms of your request, could you please provide the following information:
•Location – carriage number (incident not show at second carriage from front)
•Personal description – gender, hair colour, height, glasses
•Incident previously reported – provide details of which train station a report was made to and the date it was reported – an incident number would also assist with the retrieval of the footage

Location – carriage number, Can we check the 3rd Carriage from the front. upper deck
I am sure its either second or 3rd carriage as i got down just ahead of lift at wentworthville
•Personal description – Male ( Indian), Hair colour Black, height 167cm. No beard. No glasses, Black Formal Pant and Blue formal shirt. Black shoes. Had medium-large brown parcel in my hand. that should be easily visible. I can send photo of it if needed i don't see place to attach the photo
•Incident previously reported – Incident was reported at Wentworthville station on 31 Jan at around 3PM. i also reported it on line at lost and found property (reference ST28639.)
Phone is IPHONE XS silver with hard back cover of black colour on it. It also had wallpaper of my baby
From the window of train i could see the Male moving to my seat after i got down, i couldn't quickly get into the train as door was closed.

Afternoon Prashant,
A search has been undertaken by the Sydney Trains and the footage for the timeframe of your request has now been located.
I have reviewed the footage found and while there does not appear to be visible images of anyone pick up your phone, footage covering the period identified was preserved.
Next Steps
Please follow one of the following means of requesting access to the CCTV:
•The NSW Police can request a copy of the footage via IASK. If they are unable to do so, please advise them to direct their enquiries to this office
•If the matter is for court, please submit a Subpoena to the relevant agency and advise the legal counsel of the above reference number.
•Should neither of the above apply, or you wish to apply to view the CCTV footage, you may apply for access to the information through a formal application under the Government Information (Public Access) Act 2009 (GIPA Act).
Please note: Applications under the GIPA Act are considered on a case-by-case basis and in some circumstances (where there is an overriding public interest against doing so) access is not provided to the applicant.
