I refer to your correspondence received on 2 November 2021 seeking access to documents held by the Department of Home Affairs (the Department) under the Freedom of Information Act 1982 (the FOI Act).

Scope of request
You have requested access to the following:

I would like to know the number of applicants who attended citizenship ceremonies in Brisbane City Council. The requested time period is from 1 sep 2021 to 29 november 2021. Please send the total number of applicants that attended citizenship ceremonies in Brisbane City Council at the end of each month.
Your request was received by the Department on 2 November 2021 and has been allocated FOI request number FA 21/11/00208 . Please include your FOI request number in all correspondence with the Freedom of Information Section.

The Department is unable provide the complete data set that you have requested, as the reporting period is incomplete. The Department will process your request to the nearest completed reporting milestone, which is 31 October 2021 .

If you would prefer to withdraw your request and resubmit it when the full data set is available (Mid December 2021) , please advise the Department via return email.

Timeframe for receiving your decision
The statutory timeframe for processing a request is 30 days from the date upon which your application was received by the Department.

Dear Prashanth Venkatesh

 

Notification of invalid Freedom of Information internal review request

I refer to your email received by the Department of Home Affairs (the
Department) on 02 November 2021 in which you requested an internal review
in relation to your Freedom of Information request FA 21/11/00208.

On 05 November 2021, the Department acknowledged your request and advised
you that the full data you were seeking was not available. You were
offered the opportunity to withdraw your request and submit a new request
when the data was available.

On 08 November 2021, the Department received correspondence from you
stating ‘please inform me in December.’ The Department subsequently took
this as confirmation to withdraw your request and finalised it without
making a decision.

 

Whether internal review request valid

The right for an applicant to seek internal review is specified in Part VI
of the FOI Act, which provides that an applicant may request an internal
review of an ‘access refusal decision’ made by an agency. The types of
decisions that are reviewable access refusal decisions are [1]specified in
section 53A of the FOI Act.

Unfortunately, as the Department interpreted your previous correspondence
as confirmation to withdraw your request, and finalised it without making
an access decision, the Department has not made a decision that meets the
requirements of a reviewable access refusal decision as defined in section
53A of the FOI Act. Consequently your internal review request is invalid
and we cannot review the decision.

 

Next steps

Should you still wish to seek access to the information requested, you may
wish to lodge a new FOI request. Should you make a new request, the
Department could then make a decision on the request for which you would
have the right to seek internal or external review.

 

Making a complaint to the Office of the Australian Information
Commissioner

You may complain to the Australian Information Commissioner about action
taken by the Department in relation to your request.
