Dear Misty Leavold,
Thank you for your email.
Please could you confirm the schedule or paragraph of NT's Information Act (2002) that you consider provides an exemption to withhold the information?
The standard exemptions regarding personal or private information are not relevant to this, particularly as it addresses aggregated data for the entire workforce.
In the Act, Part 1(4) defines the term record as "recorded information in any form (including data in a computer system) that is required to be kept by a public sector organisation as evidence of the activities or operations of the organisation, and includes part of a record and a copy of a record."
On this basis, the information held by NT Police does not appear exempt from disclosure.
Thank you.
Yours sincerely,
T Smith
Good afternoon,
The definition of "Government Information" is a record held by or on
behalf of a public sector organisation and includes personal information.
The definition of "Record" is recorded information in any form (including
data in a computer system) that is required to be kept by a public sector
organisation as evidence of activities or operations of the organisation,
and includes part of a record and a copy of a record.
Statistics of NT police officers charged with offences does not exist as a
record.
A government agency is not required to create new documentation or records
to satisfy a Freedom of Information request. We are required to provide a
copy if applicable, if a record is already in existence, which in this
instance, is not the case.
If you would like to seek further advice I welcome you to contact the
Northern Territory Information Commissioner - [email address]
