Department of the Senate,

I request any documentation acknowledging the receipt of Notice of Quo Warranto delivered by hand to the Clerk of the Senate Richard Pye, and to Murray Watts (his office) on 12th July 2024 by former Senators Rod Culleton and Len Harris.
I also request copy of documents and/or correspondence from Richard Pye to Senators regarding that Notice of Quo Warranto ie to inform the Senators of the Notice.

Jillian,
Respectfully, without waiver of inherent rights under the Commonwealth of Australia, established 1900.

Dear Department of the Senate,

I have been reminded your department is required by law to respond within a certain time (by September 9, 2024).
The request is simply administrative records acknowledging receipt of, and subsequent distribution of, a Notice to the Senators of the Parliament.

We await confirmation of both events.

Jillian,
Respectfully, without waiver of inherent rights under the Commonwealth of Australia, established 1900.

Usher of the Black Rod (SEN), Department of the Senate

Dear Jillian

The Department of the Senate is exempt from Freedom of Information Act requests by s.68A of the Parliamentary Service Act 1999, however, responses may be provided to requests for administrative information of the department.

There is no documentation that meets the terms of the request.

The document referred to in the FOI request is a document with no legal force or standing that contains political material. As such, it would be inappropriate for the department to circulate it to senators. If the signatories to the document want it to be presented to the Senate, they will need to find a senator who is willing to take that action. In addition, the validity of Acts of Parliament once they are assented to is a matter for the High Court of Australia, not the Senate or the Senate department. These points were made to the signatories who delivered the document when it was delivered.
