FOI2425022
Dear Jake
I am writing in relation to your FOI request sent to the nbn FOI email on
11 December 2024.
Application
Your application seeks “the nearest node is located to our property”,
being the address specified in your application.
Under section 3(1)(b) of the FOI Act, the public has a right to seek
access to “documents” rather than to discrete bits of information.
However, section 17 of the FOI Act enables nbn to provide applicants with
information if that information is not available in a discrete written
form but it is “ordinarily available to the agency for retrieving or
collating stored information”. In that regard, it would be possible to
create a document containing the information within the scope of the
current request (Relevant Information).
Access Decision
In making this decision, nbn considered relevant parts of the FOI Act and
related legislation, the Office of the Australian Information Commissioner
(OAIC) FOI Guidelines, relevant case law and other sources.
It is my view, having regard to the nature and subject matter of the
request and the relevant provisions of the FOI Act, that one or more
exemptions to release are applicable, as outlined below.
nbn’s Commercial Activities Exemption
I refer you to nbn’s commercial activities carve-out (CAC) or carve-out
from the application of the FOI Act and refer you to section 7(3A) and
Part II of Schedule 2 of the FOI Act. Documents that are in relation to
nbn’s “commercial activities” are not subject to the operation of the FOI
Act and would be exempt from release. The following link ([1]see here)
summarises and provides general background information concerning nbn’s
commercial activities carve-out. That background document references two
reviews by the Australian Information Commissioner that considered nbn’s
CAC: the Internode Decision (in January 2012) and the Battersby Decision
(in July 2013).
nbn has previously made FOI decisions refusing access to requests for
documents and information that relate to its network infrastructure, such
as the locations, distances and routes between nodes and residences. These
decisions were made based on nbn’s CAC, and for security reasons, among
other grounds.
Accordingly, I find that nbn’s Commercial Activities Carve-out (CAC),
under section 7(3A) of the FOI Act, is applicable in respect of this
application. The Relevant Information relates to nbn’s commercial
activities and is not subject to application of the FOI Act. I therefore
refuse access to the Relevant Information.
Decision-making Time and Fees
The time for consideration and decision-making involved in this
application has been less than five hours. No fees are levied for the
first five hours of FOI decision-making time and accordingly no fees are
payable in respect of the decision-making time in this instance.
An FOI decision may be reviewed, subject to sections 53A and 54 of the FOI
Act. Please refer to the Office of the Australian Information
Commissioner’s website at the following link ([2]see here) which provides
details about your rights of review and other avenues of redress under the
FOI Act.
***
I suggest that you discuss any network issues with my complaints team
colleagues. Please call me on the number below if you would like to
arrange this.
I look forward to hearing from you.

Dear NBN Co Limited,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of NBN Co Limited's handling of my FOI request 'Node location'.
[ GIVE DETAILS ABOUT YOUR COMPLAINT HERE ]
We have contacted internet providers that simply don't know, we have called every installer located on the NCNco website, all say to call each other and don't know.
We simply need to know the location or distance to our property to confirm the costs to have fibre to the premises installed. Our property is 50 acres and the information is required for our business ran from the location.
Since noone seems to know or be able to assist our only option looks to be starlink.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/n...
Yours faithfully,
Jake Kersley

Dear Jake – following our conversation last week, I confirm that you
indicated you were happy to withdraw your request for an Internal Review
of my decision. Accordingly, nbn will not conduct the Internal Review.
Please contact me if you have any questions about that.
In the meantime, my colleague has left some messages for you to call as
discussed.
