Please provide a copy of the "Risk Management Framework" cited in the NDIA Annual Report 2013-2014[1].

Context:

Page iv: "The NDIA Board established its governance procedures and implemented an extensive risk management system."

PAGE 65: " A robust risk management framework is essential for the Agency’s operations and the overall sustainability of the Scheme. The framework and approach adopted by the Board is set out in the National Disability Insurance Scheme—Risk Management Rules 2013 (Risk Management Rules). Consistent with these rules, and reflecting the insurance basis of the Scheme, the Board adopted the Prudential Risk Standard (CPS 220) promulgated by the Australian Prudential Regulation Authority as the overarching policy for risk management activities in the Agency. CPS 220 aligns closely with the provisions of the Commonwealth Risk Management Policy issued as part of the new Commonwealth accountability framework under the PGPA Act. As required by the Risk Management Rules, the Board finalised a Risk Management Strategy 
in early 2014. The Risk Management Strategy as an integral part of the Board’s broader Risk Management Framework. The Strategy:
- outlines the risk governance relationship between the Board, committees of the Board and the senior management of the Agency 

- describes the processes for the NDIA to identify and assess risks, establish mitigation and control mechanisms for individual risks and monitoring and reporting issues in relation to risk 

- describes how the NDIA will raise staff risk awareness and develop an appropriate risk culture 

- sets out specific risk management roles and responsibilities and establishing a process to review the effectiveness of the framework "

Extension of time application by the National Disability Insurance Agency

 

Dear Shirley

 

I write to advise that on 9 August 2021, the Office of the Australian
Information Commissioner (the OAIC) received an application from the
National Disability Insurance Agency (the NDIA) for an extension of time
to process your 5 FOI requests made on 9 June 2021, which have been
combined by the NDIA under reference FOI 20/21-0843. These are your
requests titled:

1.    NDIA Audit and Risk Committee Charter/Terms of Reference: 2014

2.    NDIA Risk Management Consultancies: 2014

3.    NDIA Risk Management Declaration: 2014

4.    NDIA Risk Management Framework: FY 2013-2014

5.    NDIA Risk Management Strategy: 2014

The NDIA has advised the OAIC that you agreed to an extension of time to
process the requests under s 15AA of the FOI Act to 9 August 2021 (OAIC
reference RQ21/01832).

 

The NDIA has applied for an extension of time under s 15AB of the Freedom
of Information Act 1982 (Cth) because your requests are considered to be
complex and voluminous. 

·     The NDIA has advised the OAIC that:

−     the requests are broadly scoped and cover both current and
historical documents

−     the requests seek access to documents of a highly sensitive and
complex nature from multiple business areas

−     the NDIA has combined requests where possible and is engaged in a
significant amount of consultation with multiple stakeholders to ensure it
has appropriately identified documents within scope, and determine whether
it needs to further engage with you

−     searches for historic material have been complex as ICT
infrastructure has changed over time and other Commonwealth agencies hold
the archived material, and

−     the NDIA is committed to issuing a decision as soon as possible.

The NDIA has requested an extension to 8 September 2021. I will take any
comments you may have to make into account when deciding the application.

 

Please respond to this email by close of business 13 August 2021. If I do
not hear from you by this date, I will proceed to make a decision on the
basis of the information provided to me by the NDIA.

 

You will be notified of the decision once the matter has been finalised.

I contest the charge has been wrong assessed or should be reduced.

Another response that took 90 days to supply.

Noting you or your department have not personally sighted and evaluated the said documentation or the actual time requirements (as communicated in the statement 'I am advised'), further evidentiary evaluation remains forthcoming. Moreover, the requested documentation are matters of not only public record but foundational to multiple NDIA public statements, attestations and assurances. Therefore, all documents should be readily available and retrievable if adequately and appropriately stored/archived. In short, not requiring 12 hrs of electronic search and 13 hrs of discussion.

As this appears to be a new trend for FOI requests that have taken well over the prescribed 30 day period, is this a new SOP to inhibit provision and access to NDIA public records? If they exist that is.

Lastly, this clustering of requests is an artificial fabrication of complexity and relationship. In other words, when individual requests are made, it appears to be NDIA practice to bundle them into a longer lists, take 90 days to respond then claim it took an unsubstantiated time and cost, justifying fees and charges for poor governance and procedures. As a result, I reasonably contest this evaluation has been made in the absence of verifiable evidence and consideration.
