NDIA phone recordings policies
Dear National Disability Insurance Agency,
I would like to request any documents which state the NDIA's policies, procedures, guidance documents etc. about the recording of phone calls made to/from the NDIA. If relevant, I would like the documents to show the contact number unredacted which the policy is referring to. I would additionally like any documents which provide guidance for what NDIA staff should do if a caller states that they are recording the call or asks for permission to record the call.
Yours sincerely,
Gabriel

Dear Gabriel
Freedom of Information Request: Acknowledgement
Thank you for your request of 23 October 2024, made under the Freedom of
Information Act 1982 (FOI Act), for copies of documents held by the
National Disability Insurance Agency (NDIA).
Scope of your Request
You have requested access to:
“…I would like to request any documents which state the NDIA's policies,
procedures, guidance documents etc. about the recording of phone calls
made to/from the NDIA. If relevant, I would like the documents to show the
contact number unredacted which the policy is referring to. I would
additionally like any documents which provide guidance for what NDIA staff
should do if a caller states that they are recording the call or asks for
permission to record the call…”
Irrelevant Information
Section 22 of the FOI Act allows an Agency to redact information from
documents if that information would reasonably be regarded as irrelevant
to a request for access.
Given the nature of your request, it does not seem that NDIA staff
members’ surnames and contact details would be relevant to you. Can you
please send me a reply email confirming that such details are irrelevant
to your request for access?
Processing Timeframes
In accordance with section 15(5)(b) of the FOI Act, a 30-day statutory
period for processing your request commenced from 24 October 2024. This
30-day period expires today 22 November 2024.
The 30-day period can be extended in several ways, including with your
agreement.
Unfortunately, it is currently taking us a little longer than 30 days to
process FOI requests. I am therefore seeking your agreement to a 30-day
extension of time under section 15AA of the FOI Act. If you agree to this
extension, the new due date for us to a decision on your request will be
22 December 2024.
If you do not agree and we are unable to process your request within the
30-day period expiring today, 22 November 2024 we will be deemed to have
refused your request and you will not have a right to seek internal review
of that decision. You will, however, retain your right to external review
by the Australian Information Commissioner.
Please let us know if you agree by the end of today, 22 November 2024.
Disclosure Log
Subject to certain exceptions, documents released under the FOI Act will
be published on the NDIA’s disclosure log located on our website.
If you have any concerns about the publication of the documents you have
requested, please contact me.
Next steps
Your request will be allocated to an authorised FOI decision-maker. The
decision-maker may need to contact you to discuss a range of matters,
including refining the scope of your request.
We will contact you using the email address you have provided. Please
advise if you would prefer us to use an alternative means of contact.
In the meantime, if you have any questions or need help, please contact us
at [1][NDIA request email].
Regards
Megan

Dear foi,
I agree to the 30 day extension and the removal of NDIA staff
members’ surnames and contact details from any document provided.
Yours sincerely,
Gabriel
Dear foi,
Can you please provide the requested information? You have gone over the extension date I agreed to.
Yours sincerely,
Gabriel
Dear National Disability Insurance Agency,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of National Disability Insurance Agency's handling of my FOI request 'NDIA phone recordings policies'.
I have not received any documents or further communication from the NDIA after the 30 day extension I agreed to. The 30 day extension period has now passed with no contact.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/n...
Yours sincerely,
Gabriel
Hello and thank you for writing to the FOI team.
Please be advised that during the holiday period, the NDIA FOI offices
will be closed from Tuesday 24 December 2024 until Thursday 2 January
2025.
If we receive an FOI request from you during the period of shut down,
noted above, our staff will not be able to commence processing the matter
or respond to any queries until Thursday 2 January 2025.
Kind regards
NDIA FOI Team

Hi Gabriel,
Thanks for your email.
I’m sorry about the continued delays with your FOI request.
I am writing to give you a progress update on your request and clarify
your review rights.
Progress update
I have conducted search consultations with a business area in the NDIA to
locate the documents you are seeking. We are currently assessing the
documents that fall within the scope of your request.
Review application
Thank you for your request for internal review of your FOI application.
However, I am sorry to advise you that as your request has not been
processed within the statutory timeframe, it is now considered a
‘[1]deemed access refusal.’ This means we are still processing your
request and are committed to providing you with our decision. However, it
also means that unfortunately you do not have internal review rights at
this stage. Therefore, we are sorry to advise that we can’t process your
request for internal review. If you would like to seek review of our
deemed access refusal decision, your next step is to seek external review
with the [2]Office of the Australian Information Commissioner (OAIC).
However, I would like to reassure you that I have prioritised your request
and I am striving to give you a decision as soon as practicable.
If you have any questions, please reach out. If there are any further
delays, I will keep you updated.
Kind regards
Megan
