Dear NBN Co Limited,

I refer to my previous FoI request (NBN reference: FOI1213/19.23)
and the Statement of Reasons from that request, specifically point
12 where it states:

"In that context [referring to point 11], NBN Co staff informed me
that it would be possible to establish preliminary or draft figures
in line with the Applicant's request by drawing information from
various NBN Co databases. As permitted by section 17 of the FOI
Act, it would then be possible to create a new document containing
the relevant information."

As per my previous FOI requests to NBNco in FOI1213/19 and FOI1213/25, I now hereby request the same statistics on the NBN
rollout, as at 30th of June 2013.

1) Brownfields Fibre Rollout
a) Number of premises under construction;
b) Number of premises passed (able to order a service);
c) Number of premises with an active Brownfield Fibre NBN service.

2) Fixed Wireless Rollout
a) Number of premises covered by an 'actively under construction'
tower site;
b) Number of premises covered by active tower site (able to order
a service);
c) Number of premises with an active Fixed Wireless NBN Service.

3) Interim Satellite coverage
a) Number of premises with an active Interim Satellite NBN
Service.

Notwithstanding the information at point 13 in FOI1213/19.23 to
ensure accuracy and completeness of data, I fully expect that NBN Co will should be able to provide this information inside the legislated period of determination.

I appreciate your consideration in making a determination of this

Dear Adam (and David),

I note from your reply on the 2nd of August that you acknowledged that you would respond to this FOI request by the 31st of August.

Taking it into account that the 31st of August was a Saturday, I would have been quite happy to have received another response by the close of business on the 2nd of September, the next business day. A further 48 hours have passed and I would have expected a response by now.

I remind you of the requirements of the Act to respond to a request within the allotted time, something that has not been done. It is my belief that NBNco is in breach of the Act.

There is no reason why NBNco should not release this information in the light of Caretaker Conventions, since there can be no government or departmental release of this information for this Parliament, and so NBNco should expedite the release of this information so that the public can be informed prior to the September 7 poll.
