The AFP, in its management of FOI requests, excludes the following information on the basis that is irrelevant to the scope of a request:

- Names of AFP members, other than the Senior Executive.

Dear Mr Hirsch,

I refer to your FOI request in which you seek access to documents under
the Freedom of Information Act 1982 (the Act).

Upon consideration of your request, the AFP is of the view that the
request will take longer than 30 days to process. The delay is
regrettable, however, due to searches still being undertaken to locate
documents it will not be possible to advise you of a decision by 18 July
2018.

Accordingly, pursuant to section 15AA of the Act, I am seeking your
agreement to extend the period to notify you of a decision to 17 August
2018.

I would be grateful if you would advise in writing by return email, of
your agreement to the proposed extension of time.

If you have any queries in relation to this matter, please do not hesitate
to contact me.

Yours sincerely,

Dear Australian Federal Police,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Australian Federal Police's handling of my FOI request 'MOU between INP and the AFP on Combating Transnational Crime'.

I do not agree with the decision for this request. According to the decision, "MOUs between the Commonwealth and foreign governments are, by their nature, confidential agreements". I would like to dispute this reasoning.

Not all MOUs are confidential in nature. In fact, a number of MOU's between AFP and INP have already been made public. For example, see the 2005 MOU available publicly here:
http://www.interpol.go.id/en/legal-matte...

Similarly, many other MOUs between the Commonwealth and other foreign governments are public.

The reasoning behind the refusal to provide this document is incorrect. I request an internal review of this decision.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/m...

Yours faithfully,

Asher Hirsch
