Dear Mr Monceaux,
1. I refer to your correspondence dated, 23 August 2016,
in which you sought access, under the Freedom of Information Act 1982
(FOI Act), to:
“ am writing to request access to minutes of all meetings of the Woomera
Prohibited Area Advisory Board under the Commonwealth Freedom of
Information Act 1982.
Excludes personal email addresses, signatures, personnel (PMKeyS) numbers
and mobile telephone numbers also exclude duplicates of documents..”
2. In our letter dated 29 August 2016 you were advised
that the charges associated with your request had been imposed. The
statutory deadline for a response to this request was 10 October 2016.
3. Your request was forwarded to Associate
Secretary Group for consideration. Ms Jan Andrews, Director Information
Management Governance has advised that your request covers documents which
contain information of a commercial and personal nature of a number of
third parties.
4. Ms Andrews has determined that there is
a requirement to consult the third parties under section 27 and 27A of
the FOI Act, before making a decision on the release of the documents.
5. Subsection 15(6) of the FOI Act provides for an
extension of 30 days to the statutory time limit for processing requests.
Therefore, the deadline for providing you with the decision on your
request is now 11 November 2016.
[1]6. I would be grateful if you could confirm if the
FOI Directorate could disclose your identity as the applicant to the third
parties for the purpose of consultation. While you are under no obligation
to reveal your identity as the applicant and we will not disclose your
identity without consent, in our experience, third parties will generally
be more likely to object to the release of their information if they do
not know who the applicant is.

Good afternoon
1. The purpose of this email is to provide you with the
decision on your request.
2. The statement of reasons detailing the Accredited
Decision Maker’s decision is at Attachment 1.
3. In summary, the Accredited Decision Maker decided to:
a. release five documents in full;
b. partially release four documents in accordance with section
22(1)(a)(ii) [access to edited copies with exempt or irrelevant
matter deleted] of the FOI Act, on the grounds that the deleted
material is considered exempt under section 47G [public interest
conditional exemptions-business] and section 33(a)(iii) [Documents
affecting international relations] of the FOI Act;

4. In order to finalise your request, you are required
to pay the remaining $89.35. An invoice for the outstanding balance will
be forwarded to you within the next 5 working days. Documents will not be
released until we receive your proof of payment.

5. In accordance with the requirements of section 11C of
the FOI Act, Defence is required to publish details of information
released under the FOI Act. Defence publishes identified documents
relating to requests within five working days of receipt by the applicant.

An invoice for the remaining fees was received today via personal email. It has since been paid in full using BPay. I am impressed with the invoicing system that the Department of Defence uses, which makes paying these invoices quick and painless when compared to some other agencies I have lodged requests with.
