Good afternoon Ms Crosby
FREEDOM OF INFORMATION REQUEST – NOTIFICATION OF RECEIPT AND REQUEST FOR
AN EXTENSION OF TIME
I am writing to notify you that the Department of Health (department)
received your request on 26 October 2021 for access to documents under the
Freedom of Information Act 1982 (Cth) (FOI Act) being:
A list of all applications for NHMRC or MRFF funding over
the past 5 years for migraine, including whether they were successful or
unsuccessful
Partial transfer of request
Documents relating to part of your request are held by another agency. As
such the National Health & Medical Research Council (NHMRC) has agreed to
accept partial transfer of your request so far as it relates to:
A list of all applications for NHMRC funding over the past 5 years for
migraine, including whether they were successful or unsuccessful
An officer from the NHMRC will be in contact with you directly regarding
that part of your request.
Request for extension of time
The statutory timeframe for processing your request is 30 calendar days
within which a decision on access to the requested documents is to be
notified.
As a result of the ongoing coronavirus pandemic, the department is dealing
with a very high volume of FOI requests. To ensure the department can
process your request in accordance with the requirements of the FOI Act,
including locating and providing access to all relevant documents, the
department would be grateful if you would agree to an extension of 30
calendar days for processing your request. If you agree, the department
will endeavour to provide a decision to you by 24 December 2021.
Next Steps
Please contact the department by 17 November 2021 with your decision to
the 30 day extension of processing time.
Unless you advise otherwise, draft and duplicate documents and
Commonwealth employee names and contact details below Senior Executive
Service level and mobile telephone numbers of all staff will be excluded
from the scope of your request under s22(1)(a)(ii) of the FOI Act.
The department may impose a charge for the work involved in providing
access to the documents. If this request attracts a charge you will be
notified in writing.
You can contact the FOI Unit via email at [email address], should you
have any questions.

Dear Ms Crosby
I refer to your request of 26 October 2021 to the Department of Health
(department), seeking access under the Freedom of Information Act 1982
(Cth) (FOI Act) in the following terms:
A list of all applications for MRFF funding over the past 5
years for migraine, including whether they were successful or
unsuccessful.
Notice of Third Party Consultation
It appears, from the documents to which you seek access, a third party may
reasonably wish to make a contention concerning possible exemption of some
of the documents. Accordingly, the department has determined the
requirements of section 27 and 27A of the FOI Act make it appropriate to
extend the time frame for dealing with your request.
Pursuant to subsection 15(6) of the FOI Act, the period for providing you
with a decision has been extended by a further period of 30 days. This
means the department will endeavour to provide you with a decision on or
before 25 December 2021.
Relevant provisions
The FOI Act, including the provisions referred to in this email, can be
accessed from the Federal Register of Legislation website.
If you require clarification of any of the matters discussed in this email
you should contact the department’s FOI Unit on (02) 6289 1666, or by
email at [1][email address].
Kind regards

Dear Ms Crosby
Re - Freedom of Information Request: No. 2021/22-010
I refer to your request under the Freedom of Information Act 1982 (FOI
Act), which has been partially transferred to the National Health and
Medical Research Council (NHMRC) from the Australian Government Department
of Health (the Department) under section 16 of the FOI Act, seeking:
A list of all applications for NHMRC funding over the past 5 years for
migraine, including whether they were successful or unsuccessful.
I note that the Department wrote to you on 15 November 2021 to acknowledge
receipt of your request and advise that your request would be partially
transferred to NHMRC.
Timeframe for receiving your decision
The statutory timeframe for processing a request is 30 days, starting from
the day after the day on which your application was received. Therefore,
the due date for a decision on your request is 25 November 2021.
This timeframe may be extended where:
· charges are levied as prescribed by the Freedom of Information
(Charges) Regulations 2019 (FOI Regulations) (see charges below)
· consultation with third parties is necessary (see consultation
with third parties below).
Charges
Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. These charges are set by the FOI
Regulations and are for search and retrieval of documents, decision making
and provision of access (for example, copying and postage).
If NHMRC decides to charge you in respect of this FOI request, we will
send you a preliminary assessment of the charges as soon as possible
following retrieval of any documents that may be relevant to your
request.
Consultation with third parties
NHMRC may be required under the FOI Act to consult other parties (third
parties) where information relating to third parties arises in documents
sought by your request. The FOI Act prescribes a further 30 days
processing time for NHMRC to undertake this consultation. You will be
advised as soon as possible of any requirement to consult with a third
party.
Disclosure log
Finally, please note that section 11C of the FOI Act requires agencies to
disclose documents released under the FOI Act in a disclosure log, which
is made publicly available. There are exceptions to this requirement, such
as where release of the documents or parts of them would involve the
unreasonable disclosure of your or another person’s personal or business
information. You may choose to express a view on this issue and to
identify personal or business information that in your view would be
unreasonable to publish. However, you should be aware that section 11C of
the FOI Act embodies a pro-disclosure policy which agencies are required
to follow, subject to any exceptions provided for under the FOI Act.
If you have any queries, please contact the FOI office at:
[1][email address]
Kind regards
Kate

Dear Department of Health,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Department of Health's handling of my FOI request 'Migraine research applications for NHMRC or MRFF funding'.
I have requested a list. I specifically did not request any commercial information. The reasons to deny a list of supposedly four MRFF applications are simply bizarre. I also requested unsuccessful NHMRC applications, of which I know there are substantially more than four.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/m...
