Medical conditions & visa grants
Dear Department of Immigration and Border Protection,
In accordance with the Freedom of Information act, I would like to request the following information.
'List of medical conditions that required a referral to the Ministry of the Commonwealth that were ultimately awarded Visas in year 2015 - 2016. No patient details are required or details of any medicals undertaken. Just the name of the condition for each referred applicant that were granted a 189, 190 and 489 visa

Request for an extension of time
Please be aware that the Department has seen a significant increase in the
number of FOI requests received by this agency. As a result there are
expected delays involved with the processing of FOI requests at the
present time. Generally, requests will be processed in the order that they
are received. The Department will endeavour to finalise your request as
quickly as possible.
For this reason the Department seeks your agreement under s.15AA of the
FOI Act to extend the timeframe for the processing of your request by 30
days.
It would assist the Department in managing its FOI caseload if you could
provide a response to this request by close of business, Friday, 17
February 2017.

I appreciate the time it would take to collate such information is extensive but i think it's important to know what conditions resulted in a referral and what outcome that referral had. I'm disappointed that the FOI department do not agree.

Locutus Sum left an annotation ()
I can understand that a person will become frustrated when they do not receive a letter in the time that the person expects. But the law has not been broken. The first thing to know is that it was allowable for the agency to send the decision letter on Monday, 3 April 2017 instead of Saturday, 1 April 2017. As I said in my annotation here (https://www.righttoknow.org.au/request/e... ), s 36(2) ("Calculating time") of the Acts Interpretation Act says that "If: (a) an Act requires or allows a thing to be done; and (b) the last day for doing the thing is a Saturday, a Sunday or a holiday; then the thing may be done on the next day that is not a Saturday, a Sunday or a holiday."
The second thing to know is that a decision has been made to refuse the applicant's request. As I explained in my annotation here (https://www.righttoknow.org.au/request/s... ) there is never an "overdue" decision under the Act. I have copied some of my explanation in the other annotation to here: ... ...
The Freedom of Information Act does not ever call a decision overdue because it does not happen! This is because of the operation of section 15AC of the Act (http://www.austlii.edu.au/au/legis/cth/c.... This section looks at whether a notice of a decision has been received by the applicant, so it is not even relevant if the department actually made a decision. The section says that if the applicant has not received a notice of a decision on a request, then the request is deemed to have been refused and also it is deemed that the notice of the decision was given to the applicant on exactly the same day.
So there is never an overdue FOI decision! If a department forgets to make a decision then section 15AC will make the decision at exactly the time the decision is due. The compensation that an applicant has for a "deemed refusal" decision, instead of a decision made by a real person, is to make an application for review. There is no other method under the Act.
I do not write this to say "Do not write to the agency with a reminder." Very often the FOI officer will apologize and will eventually make a decision but it is all beyond what is covered by the FOI Act.
