Dear INFORMATION.ACCESS,
I respond to your 5 September 2024 request for an extension of time, a reply required by 6 September 2024. I apologize for the delayed response as severe storms in the Dandenong Ranges, with many fallen trees, resulted in the NBN in our area being knocked out for one week. The service was only restored late yesterday.
I am prepared to give you a 30-day extension as requested and advise if the requested information is not provided in full by 9 October 2024 you will leave me with no alternative but to seek the intervention of the OAIC.
Yours sincerely,
Alan ASHMORE
Dear Department of Veterans' Affairs,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Department of Veterans' Affairs handling of my FOI request 'Litigation policy update'.
You advised on 5 September 2024 that, "we are actively processing your request." So I ask where is it? I gave you a 30 day extension in good faith that has not been returned as almost 50 days has expired since I agreed to the 30 day extension .
Please provide the requested information without any further delay.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/l...
Yours faithfully,
Alan ASHMORE
Dear Mr Ashmore,
I write to inform you that your internal review request is an invalid request and will not be processed by the Department.
The decision for LEX 69522 is deemed, as the Department has not provided you with a decision by 8 October 2024.
As a decision has not been provided within statutory timeframes, there are no internal review rights pathway available.
Please see Part 9 of the FOI guidelines. Specifically paragraph 9.10 in the link below.
https://www.oaic.gov.au/freedom-of-infor...
The Department continues to progress your application and will provide a decision as soon as practicable.
Kind regards
