Section 54C(2) of the FOI Act is unambiguous - an internal review "must" be carried out by a delegate other than the original delegate. Not "where possible".

It is what happens - the OAIC turns a knowingly blind eye to this type of abuse that has no purpose other than to delay or discourage access.
There are plenty of examples here from DVA where they have first sought a s 15AA EOT, then made a s 15AB EOT to the OAIC who just approves it with a wink, for DVA to then stall further with bogus request consultation and third party claims, followed by a access refusal decision they knew they would make from receipt of the FOI.
It is intentional gaming by DVA, knowingly endorsed by the OAIC

Well it wasn't a third party consultation claim (yet) but a practical refusal consultation to cause further delay.
You have to admire the chutzpah of DVA to do this after getting a s 15AB extension, given the new Freedom of Information Commissioner Leo Hardiman PSM QC chastised DVA this week of knowingly attempting to delay or discourage access to information, even incurring a net financial cost to the Commonwealth to do so.
Unfortunately not much you can do but make an foi complaint to the OAIC about this egregious conduct.

Section 15AB is for giving agencies extra time to prepare documents for access. Using them to act as a way to create multiple barriers and delays to access is just dishonest.

The OAIC have approved an extension of time for DVA even though DVA have already flagged that the extension of time will be used to delay a third party consultation claim to add an additional 30 days to this extension of time granted by the OAIC.
I would complain about this if I were you Verity as DVA repeatedly uses this tactic to game prolonged delays by not undertaking concurrent processing that is reasonable to do.
This practice is directly contrary to the overarching objects of the FOI Act that support such concurrent processing given TPC is time spent mostly waiting for response.
The OAIC shouldn't have approved this section 15AB request given DVA stated it planned to later claim a TPC eot once the s 15AB eot expires.
