Dear Department of Immigration and Border Protection,

If possible, please treat this as an administrative or informal request.

Otherwise, please consider this a request under the FOI Act.

Can you please provide all Labour Agreements agreed to by the Commonwealth under the Migration Act.

I ask that all fees in relation to this request be waived because the release of the documents is in the public interest. The proactive release of such documents has been recommended by a Senate committee, including by Coalition Senators (see recommendation 3 and Coalition Senators' Additional Comments - http://www.aph.gov.au/Parliamentary_Busi... ).

Can you please provide these documents in a text-searchable format. Can you please also provide an index that covers the parties, the date agreed, the date of commencement and the date of conclusion of each agreement.

Request for an extension of time

Please be aware that the Department has seen a significant increase in the
number of FOI requests received by this agency. As a result there are
expected delays involved with the processing of FOI requests at the
present time. Generally, requests will be processed in the order that they
are received. The Department will endeavour to finalise your request as
quickly as possible.

 

For this reason the Department seeks your agreement under s.15AA of the

Dear Mr Gothe-Snape

The relevant business area advises that it is able to produce reports as requested covering from the commencement of the creation of the labour agreement database in 2011 until the date of your request (4 January 2017). There will be two reports: one for current labour agreements and one for former labour agreements (non-current).

Can you please advise whether you agree to the following revised scope for your request:

'a table of entities which have signed a labour agreement with the government, the kind of labour agreement, and the date it was signed - to include labour agreements captured in the labour agreement database which was created in 2011'.

Please note that if you accept this request it would exclude the labour agreements created before the creation of the labour agreement database.

The Department has also yet to assess whether it would be able to release to you the names of the entities which entered into the labour agreements - there is therefore no guarantee that this information would be released to you.

Dear Mr Gothe-Snape

I have consulted further with the business area. It can include the number of nominations (ie. potential visas) approved under each agreement but not the number of visas actually issued under each agreement. To find the number of actual visas issued would require extensive manual analysis of every agreement against visa systems - this would be an unreasonable diversion of resources for the Department.

The business area advises that generally the number of nominations approved for each agreement are not all utilised. As such, this data would represent the potential maximum number of visas issued under each agreement but not the actual number issued.

If you would still like this information the scope of your request could be as follows:

'a table of entities which have signed a labour agreement with the government, the kind of labour agreement, the date it was signed and the number of nominations approved for each agreement - to include only those labour agreements captured in the labour agreement database which was created in 2011'.
