I hereby request, under the Freedom of Information Act 1982, copies of the following documents:

a) Documents, including advice, that contributed to the development of the view that the implementation of the Korea-Australia Free Trade Agreement would require amendments to the Copyright Act 1968 as per paragraph 17 of the National Interest Analysis.

I also make the application that all costs for the processing of this request be waived on the grounds that the release of this information is in the public interest, will enhance the transparency of the process and the public debate surrounding apparently required legislative changes.

I refer to your request for access to documents relating to the
implementation of the Korea-Australia Free Trade Agreement under the
Freedom of Information Act 1982. I have taken your request to be for:

Documents, including advice, that contributed to the development of the
view that the implementation of the Korea-Australia Free Trade Agreement
would require amendments to the Copyright Act 1968 as per paragraph 17 of
the National Interest Analysis.

 

If you disagree with our interpretation of your request, please let me
know as soon as possible.

We received your request on 11 June 2014 and the 30 day statutory period
for processing your request commenced from the day after that date. You
should therefore expect a decision from us by 11 July 2014. The period of
30 days may be extended if we need to consult third parties or for other
reasons. We will advise you if this happens.

It is the usual practice of the Department to not release the names and
contact details of junior officers of the Department and other government
agencies, where that personal information is contained in documents within
scope of a request.  The names and contact details of senior officers will
generally be released.  We will take it that you agree to the removal of
junior officers’ personal information unless you advise that you would
like us to consider releasing that information as part of the documents
you have requested.

Dear Mr Molloy,

 

I refer to your request under the Freedom of Information Act 1982 (FOI
Act) for access to documents relating to the implementation of the
Korea-Australia Free Trade Agreement.

 

On 11 July 2014 the department sent you a notice of practical refusal
reason. As outlined in that letter, the request consultation period for
that request was for 14 days from 12 July 2014 to 26 July 2014.

 

On 22 July 2014 the department sent you an email reminding you that this
consultation period was due to expire.

 

In the letter of 11 July 2014 you were notified that, before the end of
the consultation period, you must do one of the following in writing:

·         withdraw your request

·         make a revised request, or

·         advise the department that you do not wish to revise your
request.

 

As you did not do one of the three things listed above and did not consult
the contact person during the consultation period, your request is now
considered to have been withdrawn.

 

If you wish to seek access to documents of this nature in the future you
will need to lodge a new FOI request. I note that, if you choose to lodge
the same request in the future, you may wish to consider revising the
scope of your request based upon the suggestions made by the decision
maker in the letter of 11 July 2014.

 

This freedom of information (FOI) request, matter number 14/113, is now
