Dear Australian Public Service Commission,

I’d like to make an FOI request for documents held by the APSC as a result of those documents being sent by any member of staff at the APSC who is categorised as SES, or as the ‘Public Service Commissioner’, to:

(a) the Institute of Public Affairs;
(b) the H.R. Nicholls Society; or
(c) any person in their as capacity as a member, staffer or affiliate of those organisations.

Additionally, I seek access to any documents held by the APSC as a result of those documents being received by any member of staff at the APSC who is categorised as SES, or as the ‘Public Service Commissioner’, because those documents have been sent to a relevant person by the:

(a) the Institute of Public Affairs;
(b) the H.R. Nicholls Society; or
(d) any person in their as capacity as a member, staffer or affiliate of those organisations.

A search of all items (using relevant search terms) in the email programs (eg. Microsoft Outlook) of each relevant SES staff member and the Public Service Commissioner will yield documents that fall within the terms of my request.

Dear applicant,

I refer to your request for access to documents received by the Commission on 7 May 2017.

As your request covers documents which contain personal information, the APSC is consulting the relevant individuals under section 27A of the Freedom of Information Act 1982 (FOI Act) before making a decision on the release of those documents. Section 15(6) of the FOI Act provides that the period for processing your request has been extended by 30 days in order to allow our agency time to consult with the relevant individuals. Your decision will now fall due on or before 7 July 2017.

The consultation mechanism under section 27A applies when we believe the individuals may wish to contend that the requested documents are exempt for reasons of personal privacy. We will take into account any comments we receive from the individuals but the final decision about whether to grant you access to the documents you requested rests with the FOI decision-maker.

I confirm that while we will take into account any comments we receive from the consulted individuals, that the final decision as to whether to grant access rests with the FOI decision-maker.

Due to the aforementioned consultation, the timeframe for processing your request has been extended by 30 days in order to allow our agency time to consult with the relevant individuals (section 15(6) of the FOI Act). We endeavour to provide a decision sooner where possible.

Agencies should not white out redactions, on white backgrounds, as it makes it very difficult to confirm the extent of a redaction. Agencies should use the accepted practice of black on white redactions using the Redact function of Adobe Acrobat.
