Internal Review Access and Revocation Practice Guide and Standard Operating Procedure, and "Key Indicators"

The request was partially successful.

Dear National Disability Insurance Agency,

I am requesting access under the Freedom of Information Act 1982 (FOI Act), to the following documents listed in your disclosure log:

– 22/23-1667 Internal Review Access and Revocation Practice Guide
– 22/23-1539 Fact Sheet - Free Text ‘reason for our decision’ providing guidance on writing style for reasons for decision.

I am also requesting the document which is referred to in the Internal Review Access and Revocation Practice Guide as "Complete an Access or Revocation Internal Review Decision Standard Operating Procedure".

Additionally, the Internal Review Access and Revocation Practice Guide mentions “Key Indicators”. I am also requesting access to any other documents (currently in use) which define the phrase, provide examples of, or discuss “key indicators” that are used as “evidence” in determining participant eligibility.

Kind regards,
Emily Lacey

Dear National Disability Insurance Agency,

Welcome back and happy new year, I hope you've been able to have a restful break over the holiday period.

Your response is long overdue for my request FOI 23/24-0358 which was made on September 24th 2023. It's now been 101 days without a response, which is considerably longer than the 30 days provided under the FOI Act. If you require an extension to complete your duty, please formally request one. This is the 7th email I have sent asking for a response now.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/i...

Please respond.

Dear National Disability Insurance Agency,

Your response is long overdue for my request FOI 23/24-0358 which was made on September 24th 2023. It's now been 113 days without a response. Fun Fact! I could have walked from Melbourne to Perth in that time, if I had been treating it like a full time job.

With that in mind, I feel like it's probably time you email me back to give me an update on what's taking so long. If you require an extension to complete your duty, please formally request one. This is the 8th email I have sent asking for a response now.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/i...

Have you applied for an IC Review or lodged a complaint with the OAIC?

Emily Lacey left an annotation ()

Hi RC! I haven’t done either yet, but I may. I’ve seen some other requests with the agency take up to 8 months on here, so I haven’t lost hope yet haha. Hoping that if I keep bothering them regularly they will give in.

I’m concerned that if I request an internal review that they will just close the request, because technically at this point it’s considered a “deemed refusal” and the FOI Act doesn’t allow for internal reviews of a deemed refusals because there is no “decision” to review.

I’m using a pseudonym on here so a review with the QAIC is a bit tricky, and not my first choice. I also already have a review with them for something else and it’s pretty slow moving, so I’m not sure it will get me there any faster than just persisting here for a while longer.

So my plan for now is to just continue to be a pest and I’m doing the same with my other requests which are also overdue… Taking the Shawshank Redemption approach haha

Dear National Disability Insurance Agency,

Could this email be lucky number 9?

Hi Emily,

I do not believe using a pseudonym will interfere with your ability to liaison with the OAIC. I have seen completed IC Review's on AustLII with applicants who use pseudonyms. If you do not wish to use the OAIC's website you can use the RTK website to request an IC review with the OAIC.

Best of luck with your FOI request!

Dear National Disability Insurance Agency,

It's now been 152 days since I made my request FOI 23/24-0358 on September 24th 2023. It's also the 11th email I have sent asking for you to follow up.

This is disgraceful.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/i...

You must respond, by law.

Kind regards,

Emily Lacey

Dear National Disability Insurance Agency,

160 days…

Yours faithfully,
Emily Lacey

I think I'm going to let this request die – sorry to anyone following along who was hoping for an answer.

A more recent version (V11.0) of the "Internal Review Access and Revocation Practice Guide" was released as a part of FOI 23/24-0370, and that gives some further "key indicators". You can download it here: https://drive.google.com/file/d/1soXTxqg...

Dear Emma,

Thanks for getting back to me on this request 235 days (almost 8 months) after I made it.

It’s a shame that is 205 days longer than legally required under the FOI Act, that the NDIA’s FOI office made no official request for an extension at any point, that my numerous emails requesting an update were ignored entirely, and that your response only includes two documents… neither of which appear to mention or expand upon “key indicators” as defined by the document I referenced in my original request, and one that is already a publicly available source anyway.

If it’s possible to officially (or unofficially) record my dissatisfaction in the handling of this request, you should definitely do that.

Thanks,
Emily Lacey
