Can you please provide all emails that relate to the processing of requests from applicants via Right to Know?
Can you also provide any documents that relate to the use of the below quote in emails:
"I am not satisfied that the web address you have provided meets the requirement of ‘details of how notices under the FOI Act may be sent to the applicant’ (s.15(2)(c) of the FOI Act). Rather, the address you have provided appears to be an address for publication of correspondence on the internet."
I limit the timeframe of the request to the last 6 months, and specifically exclude duplicates.
It would be appreciated if the Department could consider processing this request under Administrative Access, as the Department has been warned by the OAIC for using this reason to unreasonably delay applicants making requests via Right to Know.
I'm happy to agree to an extension of 14 days, taking into account the Christmas Period.

I limit the timeframe of the request to the last 6 months, and
specifically exclude duplicates.
For reference purposes I have numbered your request. The purpose of this
email is to seek clarification from you on the extent of the scope for
this request.
Part 1
This part of your request can be read quite broadly and the Department is
unsure as to what documents/information it is you seek to access in
connection to this part. In particular it is not clear if it is your
intention to seek; copies of attachments to emails; internal Department
emails; and/or external emails i.e. between the Department and the Right
to Know applicants.
If you could provide some further clarification surrounding the specific
documents it is you wish to access this would be of assistance.
For your information the process involved in identifying these requests,
and the relevant documents attached to each of these requests would be
resource intensive. This is because there is no report available to
identify these types of request within our case management system. As a
result a key word search within a free text field would need to occur to
firstly identify any right to know email accounts, the results of this
largely depend on the data being entered into the free text field and
would only capture those requests where the email was not latter updated.
Secondly each entry identified with a right to know email account would
need to be reviewed to identify if the request fell within the specified
timeframe. Finally a search for the request TRIM file would need to be
conducted and relevant documents extracted from this file.
Therefore, if there were specific types of requests that you were
interested in and you could identify the FA reference numbers this would
assist in identifying relevant documents.
Part 2
This part of your request is specific and although the search and
retrieval process would take some time (as I have described above) there
are possibly two requests that I can recall that may be subject to this
part of your request. These requests involved individuals seeking access
to their personal records and/or the personal records of third parties
that they may have been representing.
I do not believe that these requests remain on the Right to Know website
and should you continue to seek access to these records I would ask that
you agree to remove the personal information from the scope of your
request. As a result this would mean that any personal information within
the emails could be redacted under s.22 of the FOI Act.
Alternatively, I can suggest that you revise this part of your request to
seek access to the updated template that the Department is using for these
cases.
Next Steps
Please consider the advice I have provided above and notify the
Department, in writing, how you would like to proceed with your request,
in particular please specify the types of emails you wish to access in
connection to this request. Please provide your response by close of
business Friday 8 January 2016.

The above emails, sent by the Department, are in direct contradiction to a letter sent by Abigail Bradshaw, National Manager, Parliamentary and Executive Coordination Branch to the Office of the Australian Information Commissioner on 25 July 2014 in response to a complaint that I made regarding this behaviour. In that letter, she states that "FOI officers have been instructed that RTK email addresses are to be treated as valid addresses for notice, as required by s.15(2)(c) of the FOI Act".
If it assists me in revising Part 2, I seek:
- Documents which relate to the decision to send emails to FOI applicants via Right to Know with the below statement:
"I am not satisfied that the web address you have provided meets the
requirement of ‘details of how notices under the FOI Act may be sent to

I apologise for the delay in the processing of your FOI request. The Department has seen a significant increase in the number of requests received. While I note that the request is outside the processing timeframes of the FOI Act the Department will continue to process the request.
