Thank you for your FOI application sent on Saturday 26 October 2019 and
received by City West Water on Monday 28 October 2019.
The Freedom of Information Act 1982 (Vic) requires that an application fee
of $29.60 is paid before the request becomes valid.
We now have an online FOI portal to facilitate convenient payment of the
application fee.

City west water is obligated to provide or have available any information concerning any health and safety issues or dangers related to local residents, what regulations must be followed when constructing tanks of this size and holding this volume of water?
Where does the water come from ?
Is it bore water?
how many households are being supplied by this tank and the other 3 tanks in Melton cnr of Minns and Bulmans Road
Surely city west would have this information on hand and if the west of Melbourne is being supplied water via this low maintenance relatively low cost system do you see it fit to ask that residence are asked to pay for this information, why is city west taking a defensive position to this request.
It seems to me that there is a repeating pattern/theme to all of the large corporations and purported Government departments of late, nothing is as it seems;
*Bank loans = zero actual money
*Local councils = Not really Government
*Courts = Owned by banks
*Police = Rogue employees, but Should be appointed to office and answer only to the law
*Land titles = only register the owner for the purpose of paying rates, water service & body corp.
The web page that you have refereed me to does not have provisions for people in financial difficulty, options to waive the fees are non existent, this would suggest that city west discriminates against people who are unemployed and do not receive unemployment benefits because they choose not to be a burden on the system, and choose to live off the little savings they had tucked away for emergencies.
The term freedom implies : the condition or right of being able or allowed to do.

I refer to your request for an internal review of my decision to request payment of the $29.60 application fee or be provided with evidence that payment would cause hardship (by forwarding eg a copy of your Health Care Card).
Section 17(2A) of the Freedom of Information Act 1982 (Vic) (the Act) provides that a request must be accompanied by an application fee (in the current financial year $29.60).
Section 17(2B) of the Act provides that the application fee may be waived or reduced if payment would cause hardship.
This was the basis of my request for you to either pay the fee or provide a copy of your Health Care Card. However, you are welcome to provide other evidence that payment would cause hardship.
You should also be aware that agencies such as City West Water no longer provide an avenue for internal review.
That function is now conducted by the Office of the Victorian Information Commissioner (OVIC or the Information Commissioner).
If you are dissatisfied with my decision, you may apply for review by the Information Commissioner. You must apply in writing within 28 days after you receive this email, identifying City West Water as the agency concerned and the decision to be reviewed. You should also provide an explanation of why you disagree with the decision.

please provide the documents that have been requested
otherwise I will be filing a write of Mandamus.
As a legal practitioner your should know better than to ask me to prove that something does not exist, you know that is not possible.
I don't have a banks account , because banks engage in usury , money laundering and other unscrupulous criminal activity, I don't have centerlink, would you prefer I sign up for centerlink payments and burden the tax payer further.
does your role include pinning additional costs to the governments, budget (the people pay in the end).
I have followed the process and requested information that is available under the freedom of information act, your policy requires that I exchange currency for information that I have freedom to access -> freedom of information, if i'm required to exchange goods/services or provide payment , then it is not freedom of information.
Example , If freedom of speech is an inherent right, would it we right to ask people to pay money to exercise that right, it would be freedom of speech would it.
There is currently a legislation in place that is called the freedom of information act.
I don't really care what is entailed within the act, because if there is any literature that even remotely suggests that one would need to exchange goods,services or money then that would render the entire act invalid and in the current crisis possibly have some value as form of sanitary paper.
If the title of an act is misrepresenting the act then the act is null and void.
this policy you have , that requires people to have health care cards has never been tested against a benchmark of rational thinking and procedural fairness in high court?
like many other questionable government policies of recent.
I will try a different approach.
In my private capacity, it is my will as a living sentient being, born on the physical landmass Australia of the commonwealth and as a beneficiary of the Commonwealth of Australia trust, that you ' the representative of the trustee' please provide the requested documents or provide evidence that the request is a threat to national security, which would be the only valid reason that you cannot provide the requested information under the current circumstances.

tank.
