Historic search for legal structures with building permits for 32 & 34 Smith Sts Richmond and easement between two properties..
Dear Yarra City Council, I would like to request to see all relevant building applications and history for 32 & 34 Smith streets Richmond.
32 Smith St ARC/01/4467
34 Smith St ARC/01/4468, ARC/12/664 and ARC/12/665.
From my memory, renovations were done at 32 Smith, in 1963-65? and at 34 Smith in 1985? i would like to know which building structures are legal with building permits, and plans and drawings submitted at that time.
I also would like to investigate the private easement between these properties, created by instrument of title in 1915, Doc id, 0788807 & 0788808. Any history of the original subdivision of land, street number allocations, with property boundaries, history and changes over time.
The reason i ask is that i believe a clerical error has occurred over time when new titles have been drawn, as the evidence on the ground contradicts the current title boundaries, and plans of Surveys done on both properties, they both now show both buildings of 32 & 34 are built on the easement.
I have lived at 32 Smith since 1961, and have been the owner of 34 since 1992, my memory, photographs, and the easement shown in the City Of Yarra, Council laneway Map 2017, page 31, shows the easement as is supported by the evidence on the ground, ie. roof eaves, roof lines, spoon gutter and storm water drainage, are contrary to how it is show on today's titles, the easement is diagonal to buildings, instead of parallel to buildings as is the case in the entire street.
The reason why this is a problem now, and urgent, is that both properties must fence their properties leaving the easement clear for shared use, but the current titles show our houses built on the easement. That's why i need the search request, or an investigation as to whether an error has occurred, and which building structures are legal?
