Dear Mr Smith

 

Thank you for your email of 19 October 2024 in which you made a request
under the Freedom of Information Act 1982 (the FOI Act) to the Department
of the Prime Minister and Cabinet (the Department). You set out the terms
of the request as follows:

 

I am writing to request any available documents pertaining to His Majesty
The King's flag for Australia, as well as a high-resolution image of the
flag for educational purposes. I understand that the flag was recently
updated and used during the monarch's 2024 royal tour. Your assistance in
providing these materials would be greatly appreciated.

 

 

Timeframe for receiving your decision

The 30 day statutory period for processing your request commenced from the
day after the Department received your request, you should therefore
expect a decision from us by 18 November 2024.  The processing period of
30 days may be extended in certain circumstances and we will write to you
separately regarding any extension of time. 

 

Charges

Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the Department decides that you
are liable to pay a charge, we will send you a preliminary assessment of
the charge as soon as possible. 

 

Publication of documents

Please note that information released under the FOI Act may later be
published online on our disclosure log at

If you think you might wish to raise any objections to the publication of

Exclusion of officers’ names and contact details

For documents that fall within scope of the request, it is the
Department’s policy to withhold:

 

·         any person’s signature;

·         the names and contact details of Australian Public Service
officers not in the Senior Executive Service (SES);

·         the mobile or direct numbers of SES officers;

·         the names and contact details of Ministerial staff at a level
below Chief of Staff.

 

If you consider the information categorised above is relevant to the terms

take it that you agree this category of information may be reasonably
regarded as irrelevant and we will delete this information if it appears
in the documents that are otherwise responsive to your request.   The
names and other details of SES officers will not be withheld unless there

Information Act 1982 seeking access to:

Clarification of scope

Your request for any available documents is broadly framed and potentially
covers a large number of documents which would require third party
consultation. The Flag itself is reproduced on the Department’s website

Revising the request can focus a request and allow an agency to make a
decision in a shorter timeframe than would otherwise be possible.

 

Accordingly, you may wish to consider revising your request by specifying
the type of documents you seek, or alternatively, the type of document you
are not seeking.  

 

Seeking your agreement to extend the processing period

The Department will not be in a position to make a decision on your
request, in its current form or if revised, by the current due date of
18 November 2024. Accordingly, we are seeking your agreement to a 30-day
extension of time under section 15AA of the FOI Act. We will endeavour to
notify you of the decision prior to this extended date if possible. Please
be aware; however, that it may be necessary to apply other extension of
time, or ‘stop clock’ provisions during the processing of this request.

I am requesting a more focused set of documents, specifically those pertaining to the flag design approval on August 30, 2024, and the flag's detailed specifications. Additionally, the flag's image on the Department's website is of low quality. Dear Mr Smith

 

I write in relation to your request of 19 October 2024 made under the
Freedom of Information Act 1982 (FOI Act) to advise that the Department
has determined that it is appropriate to consult a foreign entity under
section 15(7) of the FOI Act to determine whether an international
relations (section 33) exemption applies.

 

The FOI Act provides an extension of the processing period by 30 days
(section 15(8)) in order to allow the Department time to undertake the
section 15(7) consultation. As a result the extended due date of your FOI
request is 17 January 2025.

 

We will endeavour to notify you of the decision prior to this extended
date if possible.
