Gun clubs in Australia unfair terms and conditions
Dear Australian Competition and Consumer Commission,
The following is a request under the Freedom of Information Act 1992 (the “FOI Act”).
I would like to be provided with any relevant documents relating to any cases or investigations related to any gun clubs in Australia especially in relation to unfair contract terms and conditions under Consumer Law.
Further, I am willing to agree to the ACCC removal or distortion, from any relevant document, the personal information of any person mentioned in that document, except where that person was, at the relevant time: i) a public servant; or ii) a member of parliament. Noting paragraphs 6.153-6.154 of the FOI guidelines, this refinement of my request should negate any need for the ACCC to consult with any third parties under s.27A of the FOI Act.

Unfortunately it seems that despite lodging a case (REF2434307) to the ACCC on the 20/7/18 regarding unfair contract terms imposed by some gun clubs impacting over 250,000 licensed shooters in Victoria and over 800,000 in Australia, regarding: 1) No pro rata of annual membership fees permitted (ie. join in July you pay 100% annual fee but only get 6 months membership) and 2) Even if you only want to shoot practice and no competition you have to pay a club membership (acceptable) but also HAVE TO join a registered shooting competition association regardless.
The ACCC refused to advise if they would / wouldn't investigate these unfair contract terms (Competition and Consumer Act 2010 Under Part 2-3 and Section 24) due to their internal policy. Their current response in which they cannot provide any documents under FOI because no such documents exists, is evidence that nothing occurred. What are my options?
