Section 15(2) of the Freedom of Information Act 1982 (Cth) (FOI Act) sets out the requirements for a valid FOI request. In order for a request to be a valid request for the purposes of the FOI Act, the request must:

• be in writing;
• state it is a request under the FOI Act;
• provide enough information to identify documents; and
• provide information on how to deliver notices to (or how to contact) the applicant.

As you have not provided us with sufficient information regarding the documents you are requesting, we cannot process your request in its current form.

However, as your question relates to matters pertaining to eSafety’s functions and activities, we could treat your request as an administrative access request and remove the need for you to re-make your request under the FOI Act.

Administrative access means the release of government information in response to a specific request, outside the processes in the FOI Act. Administrative access may be most readily used for release of information relating to an agency’s key functions and activities.

We would be happy to provide the answers to your question in line with the 30 day timeframe usually given under the FOI Act. This would allow you to receive the specific information you have asked for rather than documents that you would receive under the FOI.
